AN ACT concerning
Montgomery County — Board of Education — Elections
FOR the purpose of changing the deadline for the filing
of petitions nominating certain persons for
membership on the Montgomery County Board of
Education.
BY repealing and re—enacting, with amendments.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 36(b) of Article 77 - Public
Education, of the Annotated Code of Maryland (1969
Replacement Volume and 1973 Supplement) be and it is
hereby repealed and re—enacted, with amendments, to read
as follows:
Article 77 - Public Education
36.
(b) Nomination for membership on the county Board
of Education of Montgomery County, except as otherwise
herein provided, shall be by petition endorsed by a
minimum of 500 voters of the county. Each such petition
shall be filed with the board of election supervisors of
Montgomery County not later than [midnight on the Monday
which is ten (10) weeks, or seventy (70) days, before the
day on which the primary election for the political
parties shall be held] THE DEADLINE PRESCRIBED FOR OTHER
CANDIDATES FOR PUBLIC OFFICE AS SET FORTH IN ARTICLE 33,
SECTION 44-3 OF THIS CODE. Each such petition filed
shall be accompanied by a $25.00 filing fee. Except as
otherwise in this section specified, each such petition
shall conform generally to the laws and requirements of
Article 33 of this Code, provided, however, that
publication of each such petition shall not be required.
(1) If after the expiration of the time allowed for
filing of petitions by this section, there are no more
than two nominees for the county Board of Education at
large, respectively for each member then to be elected.
