HEARING TO DETERMINE WHETHER THERE HAS BEEN A VIOLATION

OF THIS SECTION, THE BURDEN OF PERSUASION SHALL BE UPON

THE INSURER TO DEMONSTRATE THAT THE CANCELLATION, OR

REFUSAL TO UNDERWRITE OR RENEW IS JUSTIFIED UNDER THE
STANDARDS SO DEMONSTRATED.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1974.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 28, 29, 30, 31, 32, 33, 34 and 35
of Article 83 — Sales and Notices, of the Annotated Code
of Maryland (1969 Replacement Volume and 1973 Supplement)
be and they are hereby repealed:
