MARVIN MANDEL, Governor                                 2559

FOR the purpose of providing for the inspection and
registration of elevators, dumbwaiters, escalators
and moving walks in places of employment; providing
for certain definitions; [[authorizing fees for
certificates of registration and inspection;]]
providing for the enforcement, issuance of citations
and penalties; and generally relating to elevators,
dumbwaiters, escalators, and moving walks.

BY adding to

Article 89 - Division of Labor and Industry

Section 4913

Annotated Code of Maryland

(1969 Replacement Volume and 1973 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 49B be and it is hereby added
to Article 89 — Division of Labor and Industry, of the
Annotated Code of Maryland (1969 Replacement Volume and
1973 Supplement) to read as follows:

Article 89 - Division of Labor and Industry
49B. ELEVATORS, DUMBWAITER, ESCALATORS AND MOVING WALKS.

(A)    NO ELEVATOR, DUMBWAITER, ESCALATOR OR MOVING
WALK SHALL BE OPERATED IN ANY PLACE OF EMPLOYMENT IN THE
STATE UNLESS A CERTIFICATE OF REGISTRATION AND INSPECTION
FOR THE OPERATION THEREOF IS ISSUED BY THE COMMISSIONER
OF LABOR AND INDUSTRY, AND UNLESS SUCH CERTIFICATE
REMAINS IN EFFECT AND IS KEPT POSTED CONSPICUOUSLY IN OR
ON SUCH ELEVATOR, DUMBWAITER, ESCALATOR OR MOVING WALK.

(B)   FOR THE PURPOSES OF THIS SECTION:

(1)   "ELEVATOR" MEANS A HOISTING OR LOWERING MACHINE
EQUIPPED WITH A CAR OR PLATFORM WHICH MOVES IN GUIDES IN
A SUBSTANTIALLY VERTICAL DIRECTION AND SERVES TWO OR MORE
FLOORS OF A BUILDING OR STRUCTURE, AND THE TERM INCLUDES
DUMBWAITERS, ESCALATORS, AND MOVING WALKS.

(2)   "DUMBWAITER1" MEANS A HOISTING AND LOWERING
MECHANISM EQUIPPED WITH A CAR OF LIMITED CAPACITY AND
SIZE WHICH MOVES IN GUIDES IN A SUBSTANTIALLY VERTICAL
DIRECTION AND IS USED EXCLUSIVELY FOR CARRYING MATERIAL.

(3)   "ESCALATOR" MEANS A POWER DRIVEN, INCLINED,
CONTINUOUS STAIRWAY USED FOR RAISING AND LOWERING
PASSENGERS.

(4)      "MOVING WALK" MEANS A TYPE OF
