FOR the purpose of providing that all law enforcement
officers have certain rights; defining terms;
specifying the procedure to be followed at an
interrogation or investigation of a law enforcement
officer; providing that records shall be kept;
providing for representation of the office;
providing a procedure for a hearing on the issues if
the investigation or interrogation results in the
recommendation of certain types of action against
the officer; providing for the evidentiary nature of
the hearing; providing for an appeal from a decision
resulting from the hearing; prohibiting certain
retaliatory actions against law enforcement
officers; and providing a procedure to apply for a
court order if a right guaranteed by this subtitle
is denied to any law enforcement officer.

Section 727 through 734, to be under the new subtitle
"Law Enforcement Officers1 Bill of Rights"

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Sections 727 through 734, to be under
the new subtitle "Law Enforcement Officers' Bill of
Rights" be and they are hereby added to Article 27 —
Crimes and Punishments, of the Annotated Code of Maryland
(1971 Replacement Volume and 1973 Supplement) to read as
follows:

LAW ENFORCEMENT OFFICERS' BILL OF RIGHTS
727.
(A) AS USED IN THE SUBTITLE, THE FOLLOWING WORDS
HAVE THE MEANINGS INDICATED.
(B) "LAW ENFORCEMENT OFFICER" MEANS ANY PERSON
WHO, IN HIS OFFICIAL CAPACITY, IS AUTHORIZED BY LAW TO
MAKE ARRESTS AND WHO IS A MEMBER OF ONE OF THE FOLLOWING
LAW ENFORCEMENT AGENCIES:
(1) THE MARYLAND STATE POLICE; OR
(2) THE BALTIMORE CITY POLICE DEPARTMENT; OR
