Maryland (1971 Replacement Volume and 1973 Supplement) be
and it is hereby repealed:

Article 35 — Evidence
[13C.

Where character evidence is otherwise relevant to
the proceeding, no person offered as a character witness
who has an adequate basis for forming an opinion as to
another person's character shall hereafter be excluded
from giving evidence based on personal opinion to prove
character, either in person or by deposition, in any
suit, action or proceeding, civil or criminal, in any
court or before any judge, or jury of this State. ]

REVISOR'S NOTE: This section is proposed for repeal
as it was revised by Chapter 2, §1 of the 1st
Special Session of 1973 to appear as §9—115 of
the Courts Article of the Code, but was
inadvertently not repealed at that time.

SECTION 4. AND BE IT FURTHER ENACTED, That Sections
26C, 26D, and 26E of Article 36 - Fees of Officers, of
the Annotated Code of Maryland (1971 Replacement Volume
and 1973 Supplement) be and they are hereby repealed:

Article 36 — Fees of Officers
[26C.

The Sheriff of Somerset County may charge and
collect these fees:

(1)   For any action or service which involves only
the serving of a paper and is not an act of execution or
attachment, a fee of $4.00.

(2)   For any action or service which includes an act
of execution or attachment, involving a seizure or a
taking into custody of any property, real or personal, or
of any person, a fee of $8.00. If the Sheriff incurs any
actual expenses for the purpose of conserving and
protecting property seized, he shall be entitled to
reimbursement for such expenditures.]

REVISOR'S NOTE: This section is proposed for repeal
as it was revised by Chapter 2, §1 of the 1st
Special Session of 197 3 to appear as §7—402 of
the Courts Article of the Code, but was
inadvertently not repealed at that time.
