Transfers, and if in any respect there is any
inconsistency between that act and subtitle 8 of this
article on investment securities the provisions of the
former act shall control.
SECTION 9. AND BE IT FURTHER ENACTED, That Sections
3-101, 3-102, 3—104, 3-106{a), 3-110(a), of Article -
Courts and Judicial Proceedings, of the Annotated Code of
Maryland (1974 Volume) be and they are hereby repealed
and re—enacted, with amendments, to read as follows:
Article — Courts and Judicial Proceedings
3-101.
(a) In this subtitle, the following terms have the
meanings indicated.
(b) "Absentee" means a person who has disappeared.
(c) "Court" means a court having jurisdiction
[under Article 93A, §105(b)] AS PROVIDED IN §13-105(B) OF
THE ESTATES ARTICLE OF THE CODE.
3-102.
If the death of a person or the date of his death is
at issue, he is not presumed dead in any proceedings
under this subtitle or under [Article 93A] TITLE 13 OF
THE ESTATES ARTICLE OF THE CODE, merely because he has
been absent from his place of residence and not heard
about for any stated period of time. The issue shall go
to the court as one of fact to be determined upon the
evidence. If during his absence the person has been
exposed to a specific peril of death, this fact shall be
considered by the court.
3-104.
Proceedings for the protection of property of an
absentee shall be conducted under [Article 93A] TITLE 13
OF THE ESTATES ARTICLE OF THE CODE.
3-106.
(a) If the court declares that the person is dead,
it may terminate the guardianship proceedings pursuant to
[§221 of Article 93AJ §13-221 OF THE ESTATES ARTICLE.
3-110.
(a) After termination of the guardianship under
§3—106 and any deduction for the insurance fund as
