THEIR DUTIES. THE MARYLAND TRANSPORTATION AUTHORITY
SHALL ESTABLISH RULES AND REGULATIONS FOR THE POLICE
FORCE WHICH ARE CONSISTENT WITH THE STANDARDS ESTABLISHED
BY THE SUPERINTENDENT OF THE MARYLAND STATE POLICE.
MEMBERS OF THIS TOLL FACILITIES POLICE FORCE SHALL
OBSERVE AND COMPLY WITH THESE RULES AND REGULATIONS.]]

(2) MEMBERS OF THE TOLL FACILITIES POLICE
FORCE SHALL NOT ACT ON PROPERTY WHICH IS NOT OWNED,
LEASED, OPERATED, OR UNDER THE CONTROL OF THE MARYLAND
TRANSPORTATION AUTHORITY, EXCEPT (1) WHEN IN HOT PURSUIT
OF A SUSPECTED OFFENDER, (2) WHEN SPECIFICALLY REQUESTED
OR PERMITTED TO SO ACT BY THE CHIEF EXECUTIVE OFFICER OR
THE CHIEF POLICE OFFICER OF ANY POLITICAL SUBDIVISION; OR
"(3) WHEN ORDERED TO SO ACT BY THE GOVERNOR.

(3) THE SECRETARY OF TRANSPORTATION, IN
CONSULTATION WITH THE SUPERINTENDENT OF THE MARYLAND
STATE POLICE AND THE MARYLAND POLICE TRAINING COMMISSION
SHALL ESTABLISH AND PROMULGATE STANDARDS. QUALIFICATIONS
AND PREREQUISITES OF CHARACTER, TRAINING, EDUCATION,
HUMAN AND PUBLIC RELATIONS AND EXPERIENCE FOR THE TOLL
FACILITIES POLICE FORCE, INCLUDING STANDARDS FOR THE
PERFORMANCE OF THEIR DUTIES; PROVIDED HOWEVER, THAT THE
STATUS OF ANY PRESENTLY QUALIFIED MEMBER OF THE CURRENT
TOLL FACILITIES POLICE SHALL NOT BE AFFECTED BY STANDARDS
ESTABLISHED AND PROMULGATED RELATING TO THE MINIMUM
HIRING QUALIFICATIONS OF TOLL FACILITIES POLICE OFFICERS
HEREAFTER. TO THE EXTENT PRACTICABLE THE SECRETARY OF
TRANSPORTATION SHALL ESTABLISH AND PROMULGATE STANDARDS
WHICH ARE CONSISTENT WITH THE STANDARDS FOR THE MARYLAND
STATE POLICE. THE MARYLAND TRANSPORTATION AUTHORITY
SHALL ESTABLISH RULES AND REGULATIONS GOVERNING THE
OPERATION AND CONDUCT FOR THE TOLL FACILITIES POLICE
FORCE WHICH ARE CONSISTENT WITH THE STANDARDS ESTABLISHED
BY THE SECRETARY OF TRANSPORTATION. MEMBERS OF THIS TOLL
FACILITIES POLICE FORCE SHALL OBSERVE AND COMPLY WITH
THESE RULES AND REGULATIONS.

SECTION 5. AND BE IT FURTHER ENACTED, That Section
3 of Article 64A — Merit System, of the Annotated Code of
Maryland (1972 Replacement Volume and 1973 Supplement) be
and it is hereby repealed and re—enacted, with
amendments, to read as follows:

Article 64A — Merit System
3.

The following positions shall not be included in the
classified service, namely: those held by officers
elected by "popular vote and officers whose appointment
and election is provided by the Constitution, including
