THE DATE OF TRIAL, INCLUDING STORAGE AND ADVERTISING, AND
THE JUDGMENT IN SUCH ACTION, IF FOR THE DEFENDANT, SHALL
BE EITHER FOR THE RETURN OF THE PROPERTY REPLEVIED, OR
FOR THE AMOUNT OF THE LIEN OR CLAIM, AND ANY ACCRUED
EXPENSES WHICH WERE PROPERLY INCURRED BY THE DEFENDANT,
INCLUDING STORAGE AND ADVERTISING; AND THE COURT MAY ALSO
ALLOW A REASONABLE COUNSEL FEE TO THE DEFENDANT'S
COUNSEL. THE BURDEN OF PROOF IN THE ACTION SHALL BE UPON
THE DEFENDANT TO ESTABLISH HIS CLAIM OR LIEN TO THE SAME
EXTENT AS IF HE WERE A PLAINTIFF IN AN ACTION TO SECURE A
JUDGMENT ON AN OPEN ACCOUNT.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1974.

AN ACT concerning

Creation of a State Debt — Maryland Academy of
Sciences Loan of 1974

FOR the purpose of authorizing the creation of a State
debt in the aggregate amount of [[Three Million
Dollars ($3,000,000)]] Two Million Dollars
($2,000,000), the proceeds thereof [[to be known as
the "Maryland Academy of Sciences1 Loan of 1974"]]
to be used to assist in the [[renovation]]
construction, renovation, improvement, and equipping
of the buildings and facilities of the Maryland
Academy of Sciences, including the acquisition of
land and the payment of architects1 and engineers*
fees; [[and for the purpose of furnishing the
buildings and facilities of the Maryland Academy of
Sciences and providing equipment for the Maryland
Academy of Sciences; and to assist in meeting
necessary operating expenses of the Maryland Academy
of Sciences;]] and providing generally for the issue
and sale of bonds evidencing such loan.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Board of Public Works is hereby
authorized and empowered to issue a State loan to be
known as the "Maryland Academy of Sciences[[']] Loan of
1974," in the aggregate amount of [[Three Million Dollars
