9.05.

THE PROVISIONS OF SECTIONS 9.01 - 9.03 ABE
SEVERABLE, AND IF ANY OF THESE PROVISIONS ARE HELD
UNCONSTITUTIONAL BY ANY COURT OF COMPETENT JURISDICTION,
THE DECISION OF SUCH COURT SHALL NOT AFFECT OR IMPAIR ANY
OF THE REMAINING PROVISIONS.]]

9.03.

(A)    FOR ONE YEAR FOLLOWING THE EFFECTIVE DATE OF
THESE SECTIONS 9.02 AND 9.03, OR UNTIL ST. MARY'S COUNTY
HAS ADOPTED AND MADE EFFECTIVE A COMPREHENSIVE ZONING
ORDINANCE AND PLAN COVERING AND APPLYING TO THE
ENTERPRISES SPECIFIED IN THIS SECTION, WHICHEVER DATE
FIRST OCCURS, A BUILDING PERMIT SHALL NOT BE ISSUED IN
ST. MARY'S COUNTY, BY THE BOARD OF COUNTY COMMISSIONERS

OF ST. MARY'S COUNTY OR ANY AGENCY OR INSTRUMENTALITY

THEREOF, TO A PERSON, FIRM, OR CORPORATION, FOR THE
CONSTRUCTION, RECONSTRUCTION, RENOVATION, OR REPAIR OF
ANY PREMISES, BUILDING, FACILITY, OR PLACE ORDINARILY
KNOWN, CHARACTERIZED, AND DESCRIBED AS INTENDED OR BEING
FOR AN INDUSTRIAL, HEAVY INDUSTRIAL. HEAVY MANUFACTURING,
OR HEAVY FACTORY ENTERPRISE OR USE.

(B)    FOR ONE YEAR FOLLOWING THE EFFECTIVE DATE OF
THESE SECTIONS 9.02 AND 9.03. OR UNTIL ST. MARY'S COUNTY
HAS MADE EFFECTIVE A COMPREHENSIVE ZONING ORDINANCE AND
PLAN COVERING AND APPLYING TO THE ENTERPRISES SPECIFIED
TO IN SECTION (A) , A PERSON, FIRM. OR CORPORATION SHALL

NOT CAUSE__TO BE ERECTED OR CONSTRUCTED IN ST. MARY'S

COUNTY, ANY STRUCTURE, BUILDING, MANUFACTURING FACILITY,
OR PROCESSING FACILITY, OR ANY FOUNDATION OR FOOTING FOR
ONE OF THE SAME. DESIGNED OR WHICH MAY BE USED FOR ANY
HEAVY INDUSTRIAL USE. NOTHING IN THESE SECTIONS 9.02 AND

9.03 AUTHORIZES OR REQUIRES THAT ANY SUCH HEAVY

INDUSTRIAL USE BE A PERMITTED USE IN ST. MARY'S COUNTY.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
is hereby declared to be an emergency measure and
necessary for the immediate preservation of the public
health and safety and having been passed by a yea and nay
vote supported by three—fifths of all the members elected
to each of the two Houses of the General Assembly, the
same shall take effect from the date of its passage.
