MARVIN MANDEL, Governor                             1925

holds, deposits, or disburses funds of [said] THE County,
including the Treasurer, Sheriff, [trial magistrates,]
and any other official handling[, such] THE funds. [;
said] THE Commissioners may remove the auditor, in their
discretion[;], and shall fill immediately all vacancies
created by removal, death, resignation or otherwise.

25.

Any wilful disregard, breach, evasion, violation or
failure to discharge any of the duties [herein] imposed
upon any member of the Board of County Commissioners, or
Board of Estimates, or on the part of the members or
member of any other board, or by or upon the part of any
official, [shall be] IS a misdemeanor, and upon
[indictment for and] conviction of [such] THE offense in
[the Circuit Court for St. Mary's County] A COURT OF
COMPETENT JURISDICTION, he shall be fined not more than
[one thousand dollars] $1,000 or imprisoned in the county
jail for not more than one year or [be] both [fined and
imprisoned in the discretion of the Court].

73.

If either of the parties, [so] making or keeping a
joint fence, [shall not] FAILS TO comply with the
provisions of Section 72, and [shall refuse or delay]
REFUSES OR DELAYS to make or repair the [said] fence[, ]
within [thirty] 30 days after notice in writing[, shall
be] IS given to him or his agent, overseer or tenant,
[upon proof thereof, before a Justice of the Peace, the
said Justice] A COURT OF COMPETENT JURISDICTION may[,
under his hand and seal,] authorize the party aggrieved
by [such] THE refusal or delay[,] to make or repair the
[said] fence [as above required] and for so doing he
shall be reimbursed the proper proportion of all costs
and reasonable expenses necessarily incurred, to be
recovered from the party [so] delaying or refusing [in
the same manner as debts of like amount are recoverable.]
TO MAKE OR REPAIR THE FENCE.

93.

In all cases where property distrained for rent in
St. Mary's county[,] is in the hands of [any bailiff] A
CONSTABLE or agent of the landlord, [and] the tenant
shall go before [a justice of the peace for said county]
THE DISTRICT COURT and confess judgment in favor of the
landlord for the amount of rent claimed and the costs of
the distraint, and shall also make before the [said
justice] COURT a supersedeas, which shall be
substantially in the following form: "State of Maryland

_____ of ______ to wit: We do confess judgment to _____,

for the sum of _____ and _____ costs, which were

confessed by_____in favor of the [said] _____ on the

_____ day of_____ before _____ [a justice of the peace]

DISTRICT COURT of the State of Maryland[, for St. Mary's
