four persons, including any owner, manager, assistant
manager, or delivery personnel, are employed by the
retail establishment or working therein, regardless of
the number of leased departments, concession areas,
booths, or stalls located therein; and

(2) Restaurants, lunchrooms, or ice-cream parlors.

Any violation of this subsection shall be prosecuted
as provided for in subsection (c) of this section.

(g) This section shall not apply (1) to any person
who conscientiously believes that the seventh day of the
week ought to be observed as the Sabbath and who actually
refrains from secular business and labor on that day, and
whose business establishment or establishments or
employees business establishment or establishments
(whether a sole proprietorship, partnership or
corporation) are actually closed on that day; or (2) to
any person who conscientiously believes that the Sabbath
begins at sundown on Friday night and ends at sundown on
Saturday night and who actually refrains from secular
business and labor during such period, and whose business
establishment or establishments or employer's business
establishment or establishments (whether a sole
proprietorship, partnership or corporation) are actually
closed during such period.

(h) Notwithstanding anything to the contrary, the
provisions of this section shall not apply to Baltimore
County, WORCESTER COUNTY, or Harford County.

(i) Notwithstanding anything in this section to
the contrary, in Calvert County general variety stores,
drugstores, dealers in boats and boating and fishing
accessories and marinas may remain open and doing
business on Sundays.

(j) Notwithstanding anything to the contrary, the
provisions of this section shall not apply to Washington
County.

522.

It shall not be lawful to keep open or use any
dancing saloon, opera house, tenpin alley, barber saloon
or ball alley within this State on the Sabbath day,
commonly called Sunday; and any person or persons, or
body politic or corporate, who shall violate any
provision of this section, or cause or knowingly permit
the same to be violated by a person or persons in his,
her or its employ shall be liable to indictment in any
court of this State having criminal jurisdiction, and
upon conviction thereof shall be fined a sum not less
