(d) The Administrator of the Motor [Vehicles]
VEHICLE Administration may promulgate rules and
regulations as necessary for the implementation of the
provisions of this [action] SECTION.

13-104.

(a)  Whenever any member of the State Police or any
officer of a county police department, or any officer of
a police department of a city or municipality observes
that a motor vehicle registered in Maryland is being
operated with equipment and mechanisms which apparently
do not meet the standards therefor as promulgated by the
[Department] ADMINISTRATION, he shall stop the operator
of the vehicle and issue to him a warning of defective
equipment and mechanisms. The warning directs the owner
of the vehicle to have the equipment and mechanisms which
are indicated on the warning as apparently defective
corrected at a place of the owner's choosing within a
period of 10 days from the date of issuance of the
warning and to forward to the Division verification by an
approved facility, signed and dated as required for a
certificate, that on a date subsequent to the issuance of
the warning the equipment and mechanisms so indicated
comply with the standards prescribed by this subtitle.
Notwithstanding any other provisions of this section, if
the warning issued to the operator of a vehicle is
related to an equipment or mechanism defect, and such
that the correction of the defect can be certified by
visual inspection and without the use of testing
equipment, the owner of the vehicle may have the defect
corrected at a place of the owner's choosing and take the
vehicle to the nearest police department authorized to
issue warnings and have the vehicle visually inspected to
insure that the defect has in fact been corrected. The
Division shall enumerate the equipment and mechanism
defects to be visually inspected under this subsection
and shall develop and institute procedures for carrying
out its provisions.

13-105.

(b)  The provisions of this section shall not apply
to:

(1)   Vehicles transferred involuntarily or vehicles
transferred under the provisions of §§ 3—114, 11-1002.1,
or [11-1002(f) (4)] 11-1002.2 (F) (4) of this article,
and in such cases, the purchaser or transferee shall
obtain a certificate as defined under this subtitle;

(2)  Sales or transfers of used motor vehicles to any
registered or foreign dealer;
