FOR the purpose of lowering the minimum capital
investment requirement for BLX alcoholic beverage
licenses in Prince George's County, and clarifying
language therein.
BY repealing and re—enacting, with amendments.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 19 (i) (5) of Article 2B - Alcoholic
Beverages, of the Annotated Code of Maryland (1968
Replacement Volume and 1973 Supplement) be and it is
hereby repealed and re—enacted, with amendments, to read
as follows:
Article 2B — Alcoholic Beverage
19.
(i) (5) In Prince George's County there [shall
be] IS, in addition to the classes herein provided, a
special Class B license known as Class BLX which shall be
issued only to luxury type restaurants; they shall be
applied for in the regular manner and shall have a
license fee of [nine hundred and forty dollars ($9 40) ]
$940. A luxury type restaurant shall be as defined by
the rules and regulations of the board of liquor license
commissioners for Prince George's County, provided that
[said] THE restaurant has a minimum capital investment of
[$300,000.00] $250,000 for dining room facilities and
kitchen equipment, which sum [shall] MAY not include the
cost of land, buildings or a lease, with a minimum
seating capacity of 150 persons. The board of license
commissioners [shall have] HAS complete discretion as to
whom these licenses shall be issued, the number to be
issued, and as to whether an existing license holder of
an alcoholic beverage license in Prince George's County
may also have an interest in one Class BLX license,
except that under no other circumstances [shall] MAY any
individual or corporation be allowed to hold more than
one license. This license [shall be] IS limited and
restricted to the purpose of providing alcoholic
beverages for consumption on the licensed premises only,
with no off-sale privileges to be exercised therewith.
