SECTION 2. AMD BE IT FURTHER ENACTED, That new
Section 36D be and it is hereby added to Article 77 —
Public Education, of the Annotated Code of Maryland (1969
Replacement Volume and 1973 Supplement) to read as
follows:

Article 77 - Public Education
36D.

(A)    ON JANUARY 2, 1975, THE BOARD OF EDUCATION OF
ALLEGANY COUNTY SHALL BE COMPOSED OF FIVE MEMBERS. THE
OFFICES HELD BY THE INCUMBENT MEMBERS OF THE BOARD
ORIGINALLY APPOINTED BY THE GOVERNOR, INCLUDING THE
MEMBER WHOSE TERM EXPIRES ON JUNE 30, 1974, SHALL
CONTINUE UNTIL JANUARY 2, 1975, AT WHICH TIME THEY ARE
ABOLISHED.

(B)    AT THE GENERAL ELECTION IN THE MONTH OF
NOVEMBER, 1974, [[AND AT THE GENERAL ELECTION EACH FOUR
YEARS THEREAFTER]] FIVE PERSONS SHALL BE ELECTED IN
ALLEGANY COUNTY TO COMPRISE THE COUNTY BOARD OF EDUCATION
OF ALLEGANY COUNTY. THEY SHALL BE ELECTED ON A
NONPARTISAN BASIS, AND NO PARTY LABELS OR PARTY
IDENTIFICATION SHALL BE SHOWN OR DISPLAYED WITH RESPECT
TO CANDIDATES FOR THESE POSITIONS ON THE BALLOTS OR
BALLOT LABELS.

(C)    NOMINATION FOR MEMBERSHIP ON THE ALLEGANY
COUNTY BOARD OF EDUCATION SHALL BE BY PETITION SIGHED BY
AT LEAST TWO HUNDRED (200) VOTERS FROM THE COUNTY. EACH
PETITION SHALL BE FILED WITH THE BOARD OF SUPERVISORS OF
ELECTIONS OF ALLEGANY COUNTY NOT LATER THAN [[MIDNIGHT]]
9 P.M. ON THE MONDAY WHICH IS TEN WEEKS OR SEVENTY DAYS
BEFORE THE DAY ON WHICH THE GENERAL ELECTION IS HELD[[;
EXCEPT THAT IN THE YEAR 1974 THE PETITION SHALL BE FILED
NOT LATER THAN MIDNIGHT ON THE DAY OF SEPTEMBER 20,
1974]]. EACH PETITION SHALL CONFORM GENERALLY TO THE
LAWS AND REQUIREMENTS IN ARTICLE 33 OF THIS CODE, BUT
PUBLICATION OF EACH PETITION SHALL NOT BE REQUIRED. ANY
PERSON SO NOMINATED SHALL BE A QUALIFIED VOTER AND A
RESIDENT OF THE COUNTY FOR AT LEAST THREE YEARS. EACH
NOMINEE AT THE TIME OF FILING HIS PETITION SHALL SUBMIT
THEREWITH A FILING FEE IN THE AMOUNT OF $25.00.

(D)    THE FIVE MEMBERS OF THE BOARD SHALL BE ELECTED
AT LARGE IN ALLEGANY COUNTY.

(E)   [[THE MEMBERS OF THE BOARD SHALL HAVE FOUR-YEAR
TERMS, BEGINNING ON JANUARY 2, 1975, AND EACH FOUR YEARS
THEREAFTER, EXCEPT THAT IF THIS DATE IS A LEGAL HOLIDAY,
THE TERM OF OFFICE SHALL BEGIN ON THE FIRST DAY
THEREAFTER WHICH IS NOT A LEGAL HOLIDAY.]] THE MEMBERS
OF THE BOARD SHALL HAVE THE FOLLOWING TERMS. THE THREE
