hereby repealed and re—enacted, with amendments, to read
as follows:

Article 59A — Mental Retardation

4.

(A)    Specific jurisdiction with regard to
administration and supervision of the care, custody and
treatment of the mentally retarded shall be delegated to
the Mental Retardation Administration which shall be a
part of the Department of Health and Mental Hygiene of
the State.

(B)    THE PROVISIONS OF SUBSECTION (A) OF THIS
SECTION SHALL NOT PREVENT MENTALLY RETARDED PERSONS FROM
BEING ELIGIBLE FOR FOSTER CARE, NOR SHALL THEY PREVENT
THE SOCIAL SERVICES ADMINISTRATION OR ANY LOCAL
DEPARTMENT OF SOCIAL SERVICES FROM PROVIDING ASSISTANCE
WITH RESPECT TO THE PLACEMENT OF MENTALLY RETARDED
PERSONS IN FOSTER CARE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1974.
