Article 77 — Public Education
85B.

(A)    HEARING AND VISION SCREENING TESTS SHALL BE
PROVIDED BY THE LOCAL BOARDS OF EDUCATION, BY THE LOCAL
HEALTH DEPARTMENT, [[AND]] OR BY THE BOARD OF SCHOOL
COMMISSIONERS OF BALTIMORE CITY FOR ALL STUDENTS IN THE
PUBLIC SCHOOLS OF MARYLAND.[[,]] HEARING AND VISION TESTS
SHALL BE PROVIDED AND FUNDED BY THE LOCAL HEALTH
DEPARTMENTS FOR ALL STUDENTS IN THE PRIVATE SCHOOLS OF
MARYLAND WHICH HAVE RECEIVED A CERTIFICATE OF APPROVAL
PURSUANT TO SECTION 12 OF THIS ARTICLE, OR IN ANY
NONPUBLIC EDUCATIONAL FACILITY LOCATED IN THE STATE OF
MARYLAND AND APPROVED AS A SPECIAL EDUCATION FACILITY BY
THE STATE DEPARTMENT OF EDUCATION. THESE TESTS SHALL BE
ADMINISTERED IN THE YEAR A STUDENT ENTERS A SCHOOL SYSTEM
AND UPON HIS ENTERING THE NINTH GRADE, UNLESS EVIDENCE IS
PRESENTED THAT A STUDENT HAS BEEN TESTED WITHIN THE PAST
YEAR. ADDITIONAL TESTING SHALL BE DONE IN ACCORDANCE
WITH BYLAWS ADOPTED BY THE STATE BOARD OF EDUCATION.
STANDARDS, RULES AND REGULATIONS TO IMPLEMENT THIS LAW
SHALL BE PROMULGATED BY THE STATE DEPARTMENT OF EDUCATION
IN COOPERATION WITH THE STATE DEPARTMENT OF HEALTH AND
MENTAL HYGIENE.

(B)    NO STUDENT WHOSE PARENT OR GUARDIAN OBJECTS IN
WRITING TO HEARING AND VISION TESTING UPON THE GROUND
THAT IT CONFLICTS WITH THE TENETS AND PRACTICE OF
RECOGNIZED CHURCH OR RELIGIOUS DENOMINATION OF WHICH HE
IS AN ADHERENT OR MEMBER SHALL BE REQUIRED TO TAKE THESE
TESTS.

(C)    THE RESULTS OF THE HEARING AND VISION TESTS
REQUIRED BY THIS SECTION SHALL BE MADE A PART OF THE
PERMANENT RECORD FILE OF EACH STUDENT AND SHALL BE
DISSEMINATED TO THE PARENTS OF THOSE STUDENTS WHO FAIL
SUCH TESTS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1974.
