MARVIN MANDEL, Governor                            1665

FOR the purpose of authorizing [[the designee of the
Commissioner]] certain officials in the Division of
Correction to exercise certain authority of the
Commissioner with respect to compassionate leave for
inmates and special and weekend leave for inmates in
a prerelease program; and correcting a reference in
the provisions generally related thereto.

BY repealing and re—enacting, with amendments.

Article 27 — Crimes and Punishments
Section 700B(a), (c) , 700C(a), (d)
Annotated Code of Maryland
(1971 Replacement. Volume and 1973 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 700B(a), (c) , and 700C(a), (d) of
Article 27 — Crimes and Punishments, of the Annotated
Code of Maryland (1971 Replacement Volume and 1973
Supplement) be and they are hereby repealed and
re—enacted, with amendments, to read as follows:

Article 27 — Crimes and Punishments
700B.

(a) The Commissioner of Correction, [[OR HIS DULY
AUTHORIZED DESIGNEE]] THE DEPUTY COMMISSIONER, THE
ASSISTANT COMMISSIONER - OPERATIONS, OR THE ASSISTANT

COMMISSIONER_____- ADMINISTRATION, may authorize

compassionate leave in accordance with the provisions of
this section for any inmate confined in any of the
institutions enumerated in § 689 of this article.

(c) Leave shall be granted only upon the written
approval of the Commissioner [[OR HIS DESIGNEEl], THE
DEPUTY COMMISSIONER, THE ASSISTANT COMMISSIONER -
OPERATIONS, OR THE ASSISTANT COMMISSIONER
ADMINISTRATION, and may be conditioned upon the inmate's
agreement to waive his right to contest extradition
proceedings. When he approves a leave, he shall issue an
authorization to the inmate for the leave which shall
specify the conditions of the leave. At the same time, a
copy of the leave authorization shall be filed by the
Commissioner [[OR HIS DESIGNEE]], THE DEPUTY
COMMISSIONER. THE ASSISTANT COMMISSIONER - OPERATIONS, OR
THE ASSISTANT COMMISSIONER - ADMINISTRATION, in [his] THE
COMMISSIONER'S office as a public record. At all times
while on leave, the inmate shall have in his possession a
copy of the leave authorization.
