TIME OF THE HEARING. IF THE PERSON SO SUMMONED DOES NOT
GIVE NOTICE THAT HE DESIRES THE PRESENCE OF THE OFFICER
AT THE TIME OF THE HEARING AS AFORESAID, IT SHALL SOT BE
NECESSARY THAT THE OFFICER WHO ISSUED THE SUMMONS APPEAR,
AND THE COPY OF THE SUMMONS BEARING THE CERTIFICATION BY
THE OFFICER SHALL BE PRIMA FACIE EVIDENCE OF THE MATTERS
THEREIN SET FORTH. THE ADMINISTRATION SHALL CAUSE NOTICE
OF THE PROVISIONS OF THIS SECTION TO BE PRINTED CLEARLY
AND IN A CONSPICUOUS PLACE IN ALL SUMMONS FOR PARKING
VIOLATIONS USED AT STATE OWNED AIRPORTS. PROVIDED
FURTHER THAT A TRIAL DATE SHALL BE NOT LESS THAN FIFTEEN
DAYS FROM THE DATE OF OFFENSE.
(C) NOTWITHSTANDING ANY OTHER PROVISION OF THIS
CODE, FINES IMPOSED FOR VIOLATIONS OF ANY PARKING
REGULATIONS ADOPTED BY THE ADMINISTRATION UNDER THIS
SECTION MAY BE COLLECTED BY THE ADMINISTRATION AND
CREDITED TO THE TRANSPORTATION TRUST FUND IN ACCORDANCE
WITH § 5-505 OF THIS ARTICLE.
TITLE 8. AIRPORT ZONING.
8-801.
(A) AN AIRPORT HAZARD ENDANGERS THE LIVES AND
PROPERTY OF USERS OF AIRPORTS AND OF OCCUPANTS OF LAND IN
ITS VICINITY, AND ALSO IN EFFECT REDUCES THE SIZE OF THE
AREA AVAILABLE FOR THE LANDING, TAKING OFF AND
MANEUVERING OF AIRCRAFT, THUS TENDING TO DESTROY OR
IMPAIR THE UTILITY OF THE AIRPORT AND IT IS THEREFORE
IN THE INTEREST OF THE PUBLIC HEALTH, PUBLIC SAFETY, OR
GENERAL WELFARE THAT POLITICAL SUBDIVISIONS OF THE STATE
BE AUTHORIZED TO ADOPT ZONING REGULATIONS, AS PROVIDED IN
THIS [[SUBTITLE]] SECTION, OR TO ACQUIRE INTERESTS IN
PROPERTY, BY PURCHASE, GRANT, LEASE, OR CONDEMNATION, IN
ORDER TO ELIMINATE AIRPORT HAZARDS.
(B) (1) FOR THE PURPOSES AND REASONS MENTIONED
IN SUBSECTION (A) OF THIS SECTION, EVERY POLITICAL
SUBDIVISION MAY ADOPT, REVISE, ADMINISTER AND ENFORCE,
UNDER THE POLICE POWER, AND IN THE MANNER AND UPON THE
CONDITIONS PRESCRIBED, AIRPORT ZONING REGULATIONS FOR ANY
NON-STATE OWNED AIRPORT LICENSED BY THE ADMINISTRATION,
WITHIN ITS CORPORATE LIMITS, OR OUTSIDE ITS CORPORATE
LIMITS TO THE EXTENT, IN THE BANNER AND UNDER THE
CONDITIONS PROVIDED IN SUBPARAGRAPH (4) OF THIS
SUBSECTION, WHICH REGULATIONS SHALL DIVIDE THE AREA
SURROUNDING THE AIRPORT INTO DISTRICTS OF SUCH NUMBER,
SHAPE AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT
THE PURPOSES OF THIS [[SUBTITLE]] SECTION; AND WITHIN
SUCH DISTRICTS IT MAY REGULATE AND RESTRICT THE HEIGHT OF
STRUCTURES OR TREES AND THE PURPOSES FOR WHICH LAND MAY
BE USED. ALL SUCH REGULATIONS SHALL BE UNIFORM
THROUGHOUT EACH DISTRICT, BUT THE REGULATIONS IN ONE
