(1971 Replacement Volume and 1973 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 42B of Article 43 - Health, of the
Annotated Code of Maryland (1971 Replacement Volume and
1973 Supplement) be and it is hereby repealed.

SECTION 2. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 42B be and it is hereby added
to Article 43 — Health, of the Annotated Code of Maryland
(1971 Replacement Volume and 1973 Supplement) to read as
follows:

Article 43 - Health
42B.

(A)    [[THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE
MAY NOT MAKE ANY PAYMENT UNDER THE MARYLAND MEDICAL
ASSISTANCE PROGRAM TO THE PROVIDER OF SERVICES RENDERED
TO PERSONS ENTITLED TO BENEFITS THEREFOR PURSUANT TO BOTH
TITLES XVIII ("MEDICARE") AND XIX ("MEDICAID") OF THE
FEDERAL SOCIAL SECURITY ACT ON ANY INVOICE RECEIVED BY
THE DEPARTMENT ON A DATE LATER THAN THAT FOR WHICH
PAYMENTS MAY BE MADE PURSUANT TO TITLE XVIII.

(B)    THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE
MAY NOT MAKE ANY PAYMENT UNDER THE MARYLAND MEDICAL
ASSISTANCE PROGRAM TO THE PROVIDER OF SERVICES RENDERED
TO PERSONS ENTITLED TO BENEFITS THEREFOR PURSUANT ONLY TO
TITLE XIX ("MEDICAID") OF THE FEDERAL SOCIAL SECURITY ACT
ON ANY INVOICE RECEIVED BY THE DEPARTMENT ON A DATE LATER
THAN TWELVE MONTHS AFTER THE MONTH IN WHICH THE SERVICE
WAS RENDERED BY THE PROVIDER. } ]

THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE SHALL
ESTABLISH RULES AND REGULATIONS FOR THE REIMBURSEMENT OF
PROVIDERS UNDER THE MARYLAND MEDICAL ASSISTANCE PROGRAM.
HOWEVER, NO PAYMENT SAY BE MADE IF AN INVOICE IS RECEIVED

ON A DATE LATER THAN NINE MONTHS AFTER THE SERVICES WERE

RENDERED EXCEPT FOR INVOICES THAT MUST BE SUBMITTED TO
