The [said] Commission is hereby authorized and
directed to appoint six medical examiners, one to be
known as chief medical examiner, one AS assistant deputy
chief medical examiner, and the other four as assistant
medical examiners [ , ]; a toxicologist [,]; two assistant
toxicologists [ , ]; a serologist [,]; FOUR RESIDENTS
TRAINING IN FORENSIC PATHOLOGY; and a chief traffic
investigator. The Commission with the approval of the
Secretary of Personnel shall fix their compensation which
shall be paid by the Comptroller of the State of Maryland
out of [[that portion of the funds collected by the
Racing Commission allocated and paid to the several
counties of the State and Baltimore City]] that portion
of the funds collected by the Facing Commission allocated
and paid to the several counties of the State and
Baltimore City [[THE GENERAL FUNDS OF THE STATE]]. The
medical examiners shall be licensed doctors of medicine,
and shall have had at least two years post—graduate
training in pathology. The [said] Commission shall
appoint, to such extent as may be authorized by the board
of estimates of Baltimore City, such other professional
or technical personnel, clerks and other employees as may
be necessary for the proper administration of the
Department and at such compensation as may be provided
for by the [said] board of estimates in the ordinance of
estimates of Baltimore City. [Such] THESE other
professional and technical personnel and the clerks and
employees shall be appointed in accordance with the
provisions of §§ 142 to 156, inclusive, of the Baltimore
City Charter (1949 Edition), known as the merit system.
Nothing in this section shall be construed to
prevent the Commission from employing the services of
physicians on a contract basis for part—time services as
may be authorized by the board of estimates of Baltimore
City.
7. If the cause of such death shall be
established beyond a reasonable doubt, such medical
examiner shall so report and file in his office within
thirty days after his notification of such death.__If,
however, in the opinion of such medical examiner, an
autopsy is necessary, the same shall be performed by the
chief medical examiner, an assistant medical examiner or
by such competent pathologists as may be authorized by
the chief medical examiner. A detailed description of
the findings written during the progress of such autopsy,
and the conclusions drawn therefrom, shall thereupon be
filed in the office of the chief medical examiner, or in
the office of the deputy medical examiner in the county
