TO ESTABLISH COMPLIANCE WITH THE LIMITS ADOPTED, TAKING
INTO CONSIDERATION ACCEPTED SCIENTIFIC AND PROFESSIONAL
STANDARDS FOR THE MEASUREMENT OF SOUND. SUCH TEST
PROCEDURES SHALL BE IN SUBSTANTIAL CONFORMITY WITH TEST
PROCEDURES CONTAINED IN APPLICABLE STANDARDS AND
RECOMMENDED PRACTICES ESTABLISHED BY THE SOCIETY OF
AUTOMOTIVE ENGINEERS, INC., OR ITS SUCCESSOR BODIES, OR
THE AMERICAN NATIONAL STANDARDS INSTITUTE OR ITS
SUCCESSOR BODIES, FOR THE MEASUREMENT OF SOUND LEVELS.

(4)         THE MANUFACTURER, DISTRIBUTOR, IMPORTER, OR

DESIGNATED      AGENT SHALL FILE A WRITTEN CERTIFICATE UNDER

OATH WITH     THE DEPARTMENT THAT THE MAKES AND MODELS

DESCRIBED           THEREON COMPLY WITH THE REQUIREMENTS
ESTABLISHED PURSUANT TO THIS SECTION. SUCH CERTIFICATES

SHALL BE      FILED FOR EACH MAKE AND MODEL SOLD IN THIS
STATE.

8-704.

(F) THE DEPARTMENT SHALL, WITH THE ENDORSEMENT OF
THE SECRETARY OF NATURAL RESOURCES AND THE SECRETARY OF
HEALTH AND MENTAL HYGIENE, AFTER A PUBLIC HEARING
FOLLOWING 60 DAYS NOTICE, ADOPT AND PUBLISH SOUND LEVEL
LIMITS GOVERNING THE NOISE GENERATED BY THE OPERATION OF
PLEASURE CRAFT ON THE WATERS OF THE STATE NOT LATER THAN
JANUARY 1, 1976. SUCH LIMITS SHALL BE ESTABLISHED AT THE
MOST RESTRICTIVE LEVEL CONSISTENT WITH THE ENVIRONMENTAL
NOISE STANDARDS ADOPTED BY THE DEPARTMENT OF HEALTH AND
MENTAL HYGIENE WHICH IS ACHIEVABLE THROUGH THE
APPLICATION OF THE BEST AVAILABLE TECHNOLOGY AND AT A
REASONABLE COST. THE DEPARTMENT SHALL PROMULGATE
REGULATIONS FOR THE ADMINISTRATION AND ENFORCEMENT OF
SUCH LIMITS, TAKING INTO ACCOUNT ACCEPTED SCIENTIFIC AND
PROFESSIONAL METHODS FOR MEASUREMENT OF SOUND LEVELS.

SECTION 11. AND BE IT FURTHER ENACTED, That in the

event of passage of a law recodifying Article 1A of the

Annotated Code of Maryland during the 1974 regular

session of the General Assembly, Sections 15(g), 15(h),

and 16—1/2 of Article 1A, as added in Section 6 of this

Act shall be codified in an appropriate place in Article
1A, as recodified.

SECTION 12. AND BE IT FURTHER ENACTED, That persons
other than the State shall not acquire actionable rights
by virtue of this Act except as specifically provided in
the Act. The basis for proceedings or other actions that
result from violations of any rule or regulation
promulgated under this Act shall inure solely to and
shall be for the benefit of the people of the State
generally and is not intended to create in any way new or
