1022                                                 LAWS OF MARYLAND                            [Ch. 287

FOLLOWING 60 DAYS NOTICE, ADOPT AND PUBLISH MAXIMUM SOUND
LEVEL LIMITS AT A SPECIFIED DISTANCE APPLICABLE TO THE
OPERATION OF THE VARIOUS CLASSES OF MOTOR VEHICLES ON THE
PUBLIC HIGHWAYS, NOT LATER THAN JANUARY 1, 1975. THE
ADMINISTRATOR SHALL TAKE INTO CONSIDERATION SUCH NOISE
EMISSION REGULATIONS AS MAY BE ESTABLISHED PURSUANT TO
FEDERAL LAW FOR MOTOR CARRIERS ENGAGED IN INTERSTATE
COMMERCE. SUCH LIMITS SHALL BE ESTABLISHED AT THE MOST
RESTRICTIVE LEVEL CONSISTENT WITH THE ATTAINMENT OF THE
ENVIRONMENTAL NOISE STANDARDS ADOPTED BY THE DEPARTMENT
OF HEALTH AND MENTAL HYGIENE WHICH IS ACHIEVABLE THROUGH
THE APPLICATION OF THE BEST AVAILABLE TECHNOLOGY AND AT A
REASONABLE COST.

(C)    THE ADMINISTRATOR, IN COOPERATION WITH THE
STATE POLICE, SHALL JOINTLY PROMULGATE REGULATIONS NOT
LATER THAN JANUARY 1, 1975, FOR THE ADMINISTRATION AND
ENFORCEMENT OF THIS SECTION, INCLUDING THE SELECTION OF
MEASUREMENT SITES AND MEASUREMENT PROCEDURES TAKING INTO
CONSIDERATION ACCEPTED SCIENTIFIC AND PROFESSIONAL
METHODS FOR MEASUREMENT OF VEHICULAR SOUND LEVELS. THESE
REGULATIONS MAY PROVIDE FOR MEASUREMENT AT OTHER THAN THE
DISTANCE SPECIFIED BY THE ADMINISTRATOR, PROVIDED THAT
THE LIMITS APPLIED AT SUCH OTHER DISTANCES ARE ADJUSTED
TO BE EQUIVALENT TO THE ESTABLISHED SOUND LEVELS.

(D)    AUTHORIZED EMERGENCY VEHICLES ARE EXEMPT FROM
THESE REQUIREMENTS WHEN OPERATING UNDER THE PROVISIONS OF
SECTION 11-106(A) OF THIS ARTICLE.

(A)    NO PERSON SHALL SELL, OFFER FOR SALE,
DISTRIBUTE OR LEASE ANY MOTOR VEHICLE IN THIS STATE AFTER

[[OCTOBER 1, 1974]] JULY__1, 1975, THAT HAS BEEN

MANUFACTURED AFTER JULY 1, 1974, THAT HAS A MAXIMUM SOUND
LEVEL POTENTIAL EXCEEDING THE SOUND LEVEL LIMITS
ESTABLISHED BY THE ADMINISTRATOR FOR MAXIMUM ALLOWABLE
NOISE EMISSIONS FOR NEW MOTOR VEHICLES. NO MOTOR VEHICLE
MANUFACTURED AFTER JULY 1, 1974, SHALL BE TITLED OR
REGISTERED IN THIS STATE AFTER [[OCTOBER 1, 1974]] JULY
1, 1975, UNLESS, WHEN FIRST SOLD FOR PURPOSES OTHER THAN
RESALE, IT COMPLIES WITH THE NOISE LEVEL LIMITS FOR NEW
MOTOR VEHICLES SET FORTH BY THE ADMINISTRATOR.

(B)    THE ADMINISTRATOR SHALL, WITH THE ENDORSEMENT
OF THE SECRETARY OF TRANSPORTATION AND THE SECRETARY OF

HEALTH AND MENTAL HYGIENE, AFTER. A PUBLIC HEARING

FOLLOWING 60 DAYS NOTICE, ADOPT AND PUBLISH MAXIMUM SOUND
LEVEL LIMITS FOR THE VARIOUS CLASSES OF NEW MOTOR
VEHICLES NOT LATER THAN SEPTEMBER 1, 1974. SUCH LIMITS
SHALL BE ESTABLISHED AT THE MOST RESTRICTIVE LEVEL
CONSISTENT WITH THE ATTAINMENT OF THE ENVIRONMENTAL NOISE
STANDARDS ADOPTED BY THE DEPARTMENT OF HEALTH AND MENTAL
