AMENDMENTS TO SENATE BILL NO. 4
By the Senate Judicial Proceedings Committee:
Amendment No. 1—

In line 5 of the title of the printed bill immediately following the comma
insert the following: "clarifying which public officials must disclose, chang-
ing the penalty for violation, creating the Financial Disclosure Advisory
Board,'; and in lines 10, 16, 21, and 25 on page 1 strike out in each instance
"28-2 and 28-4" and insert in lieu thereof "28-2 through 28-5 inclusive".

Which amendment was read and adopted.

Amendment No. 2—

Strike out in their entireties lines 27 thru 45 on page 2 and lines 1 and 2
on page 3 of the printed bill and insert in lieu thereof the following:

"(A) EVERY PERSON HOLDING AN OFFICE DESCRIBED
IN SECTION 28-3 OF THIS SUBTITLE SHALL FILE WITH THE
SECRETARY OF STATE AN INITIAL FINANCIAL DISCLO-
SURE STATEMENT AT THE TIME PRESCRIBED BY THIS
SECTION AND ON THAT SAME DATE EACH YEAR THERE-
AFTER UNTIL ONE YEAR AFTER VACATING THE OFFICE.

(B)    THE FINANCIAL DISCLOSURE STATEMENTS RE-
QUIRED TO BE FILED BY THIS SUBTITLE SHALL BE FILED:

(1)    BY ANY PERSON, UPON FILING AS A CANDIDATE FOR
THE ELECTIVE OFFICE;

(2)    BY ANY PERSON, UPON THE EFFECTIVE DATE OF
APPOINTMENT TO A POSITION;

(3)    BY ANY PERSON IN OFFICE PRIOR TO THE EFFEC-
TIVE DATE OF THIS ACT, 30 DAYS THEREAFTER.

(C)    ALL STATEMENTS FILED PURSUANT TO THIS SUB-
TITLE SHALL BE MAINTAINED BY THE SECRETARY OF
STATE AND SHALL BE MADE AVAILABLE BY HIM, DURING
NORMAL OFFICE HOURS, FOR EXAMINATION AND COPYING
BY THE PUBLIC, SUBJECT, HOWEVER, TO REASONABLE
FEES AND ADMINISTRATIVE PROCEDURES AS THE SECRE-
TARY OF STATE MAY ESTABLISH FROM TIME TO TIME.
ALL STATEMENTS SHALL BE RETAINED AS PUBLIC REC-
ORDS FOR AT LEAST TWO YEARS FROM THE DATE OF THEIR
RECEIPT BY THE SECRETARY OF STATE.

(D)    THE SECRETARY OF STATE SHALL PROVIDE FORMS
FOR USE IN THE FILING OF THE STATEMENTS REQUIRED
BY THIS SUBTITLE TO THE PERSONS REQUIRED TO FILE
STATEMENTS UNDER THIS SUBTITLE. FORMS SHALL BE
MADE INITIALLY AVAILABLE BY THE SECRETARY OF
STATE NO LATER THAN THE 1ST DAY OF DECEMBER IM-
MEDIATELY PRECEDING THE EFFECTIVE DATE OF THIS
SUBTITLE.

(E)    EVERY STATEMENT SHALL BE FILED UNDER OATH,
BASED UPON PERSONAL KNOWLEDGE AND SUBJECT TO
PENALTIES OF PERJURY.
