1973]                   OF THE HOUSE OF DELEGATES                       15

Honorable Thomas Hunter Lowe
Speaker of the House of Delegates
State House
Annapolis, Maryland

Dear Mr. Speaker:

In accordance with Article II, Section 17, of the Maryland Constitution,
I have today vetoed House Bill 594.

This bill repeals and re-enacts, Sections 5A and 12 of Article 5 of the
Annotated Code of Maryland and corrects certain errors in the laws relat-
ing to the appellate jurisdiction of the Court of Appeals.

House Bill 775, which was enacted by the General Assembly and signed
by me on April 26, 1973, repeals Sections 5A and 5B of Article 5, and
enacts new Sections 5A through 5D, re-allocating appellate jurisdic-
tion between the Court of Appeals and Court of Special Appeals.

Because of the inconsistency between House Bill 594 and House Bill
775, and because the enactment of House Bill 775 renders House Bill 594
unnecessary, I have decided to veto House Bill 594.

Sincerely,

MARVIN MANDEL,
Governor.

Read and journalized.

House Bill No. 594—By Delegate Kircher :

An Act to repeal and re-enact, with amendments, Sections 5A and 12 of
Article 5 of the Annotated Code of Maryland (1968 Replacement Volume
and 1972 Supplement), title "Appeals," subtitle "Appeals to Court of
Appeals and Court of Special Appeals," subheadings, respectively,
"Jurisdiction of the Court of Appeals and Court of Special Appeals," and
"Appeals in Criminal Cases"; correcting certain errors in the laws relat-
ing to appeals.

Shall the bill pass notwithstanding the objections of the Executive?
The Speaker announced the veto was sustained by roll call.
