(4) IF THERE IS DANGER OF COAL ROLLING ON
A PERSON DURING OR AFTER UNDERCUTTING OR CENTER
CUTTING, THE UNDERCUTTING OR CENTER CUTTING SHALL BE
SPRAGGED BY PLACING BLOCKS IN THE CUT OR BY BLOCKING
WITH LEANING POSTS.

(D) REMOVAL OF TIMBERS.—IN WORKED OUT PLACES
WHERE TIMBERS ARE BEING REMOVED, ANY PERSON ENGAGED IN
DRAWING TIMBER MAY NOT WORK ALONE.

7-409. FENCING ENTRANCES OF ABANDONED MINES.

ANY ABANDONED MINE OR PORTION OF A MINE, AND ANY
ABANDONED OPENING AND SINKHOLE TO THE SURFACE SHALL BE
FENCED OFF SECURELY AT EACH ENTRANCE.

7-410. SECURITY AS MINERS ADVANCE IN EXCAVATIONS.

THE OPERATOR SHALL DIRECT AND SEE THAT AS THE
MINERS ADVANCE IN THEIR EXCAVATION, ANY DANGEROUS AND
DOUBTFUL PIECE OF STRATA OVERHEAD IS TAKEN DOWN OR
CAREFULLY SECURED. HE SHALL ADOPT SOUND METHODS OF
TIMBERING THE ROOF AND SPRAGGING THE COAL, WHICH ARE
UNIFORM THROUGHOUT THE MINE SO FAR AS FEASIBLE AND
APPROVED BY THE DISTRICT MINE INSPECTOR. ANY WORKER
WHO NEGLECTS OR REFUSES TO OBEY ANY PROPER INSTRUCTION
OR ORDER RELATING TO SECURING HIS WORKING PLACE SHALL
BE SUSPENDED OR DISCHARGED. IF ANY NEGLECT OR REFUSAL
RESULTS IN INJURY TO ANY PERSON, THE NAME OF THE
WORKER AND THE FACTS SHALL BE REPORTED TO THE DISTRICT
MINE INSPECTOR. BUT IF ANY WORKER HAS PREVIOUSLY
GIVEN TIMELY NOTICE TO THE OPERATOR OF HIS NEED FOR
MATERIALS, OR OF AN EXISTING DANGEROUS CONDITION WHICH
HE COULD NOT PERSONALLY REMEDY, HE SHALL NOT BE HELD
TO HAVE VIOLATED THE PROVISIONS OF THIS SECTION.
