MARVIN MANDEL, Governor                                       881

as Article 66C, section 494 of the Code.
The only changes made are in style.

(E)   RECORDS AND REPORTS.—THE DIRECTOR SHALL
PRESCRIBE THE FORM OR OTHER UNIFORM METHOD FOR
OBTAINING DATA OR FOR USE IN MAKING REPORTS NECESSARY
TO DISCHARGE PROPERLY THE BUREAU'S DUTIES. HE SHALL
DIRECT AND SUPERVISE THE FIELD AND OFFICE WORK OF THE
BUREAU, SUBJECT TO THE CONTROL OF THE SURVEY, AND
"REQUIRE PROMPT REPORTING ON ANY SERVICE REQUIRED BY
LAW OR RULE OR REGULATION.

REVISOR'S NOTE: This subsection presently appears
as Article 66C, section 495 of the Code.
"Department" is proposed for deletion and
"survey" is substituted therefor because
the Department of Geology, Mines, and Water
Resources is new called the Maryland
Geological Survey. The phrase "inspectors
and other employees" is proposed for
deletion. The responsibility of the
director to direct and supervise field and
office work includes directing all bureau
personnel. The only other changes made are
in style.

(F)   INSTITUTING PROCEEDINGS.—THE DIRECTOR MAY
INSTITUTE PROCEEDINGS IN THE NAME OF THE STATE BY AN
ACTION AT LAW, SUIT IN EQUITY, OR PROSECUTION TO
ENFORCE ANY PROVISION OF THIS TITLE OR ANY RULE OR
REGULATION. THIS POWER DOES NOT EXCLUDE ANY RIGHT OF
AN INTERESTED PERSON TO INVOKE THE USUAL AND ORDINARY
PROCESS OF A COURT AGAINST A VIOLATOR OF THE MINING
LAWS.

REVISOR'S NOTE: This subsection presently appears
as Article 66C, section 496 of the Code.
The final sentence is proposed for deletion
in light of section 1-101(e) which
authorizes the Attorney General to
represent the Department. The only other
changes made are in style.

(G)    INVESTIGATING MINES.—THE DIRECTOR OR ANY
MINE INSPECTOR MAY ENTER AND INSPECT ANY MINE IN ORDER
TO DETERMINE ITS SAFETY CONDITION. IF THE INSPECTED
MINE IS FOUND UNSAFE OR IS OPERATED IN AN UNSAFE
MANNER, THE DIRECTOR OR THE MINE INSPECTOR SHALL ORDER
THE IMMEDIATE CORRECTION OF THE UNSAFE CONDITION. IF
THE UNSAFE CONDITION IS NOT CORRECTED IN THE TIME
PRESCRIBED, THE DIRECTOR SHALL ORDER THE MINE CLOSED
