DREDGING SEASON.
(A) TIME FOR TAKING OYSTERS. - A PERSON MAY NOT
CATCH OYSTERS ON SUNDAY OR BETWEEN SUNSET ON ANY DAY
AND SUNRISE ON THE FOLLOWING DAY OR LAND OYSTERS
EARLIER THAN ONE HOUR BEFORE SUNRISE OR LATER THAN ONE
HOUR AFTER SUNSET. A BUY BOAT OR BUY TRUCK MAY NOT
UNLOAD OYSTERS EARLIER THAN ONE HOUR BEFORE SUNRISE OR
LATER THAN ONE HOUR AFTER SUNSET UNLESS THE CARGO OF
THE BUY BOAT OR BUY TRUCK IS ACCOMPANIED BY A
CERTIFICATE OF INSPECTION ISSUED BY A NATURAL
RESOURCES POLICE OFFICER. THE CERTIFICATE OF
INSPECTION SHALL STATE THE POINT OF ORIGIN, AND THE
TIME OF ORIGIN WHICH SHALL BE BETWEEN SUNRISE AND
SUNSET, AND THE QUANTITY, IN BUSHELS, OF THE CARGO.
HOWEVER, ANY BUY BOAT OR BUY TRUCK MAY BE UNLOADED
BETWEEN SUNSET AND SUNRISE.
(B) TONGING SEASON. - A PERSON MAY NOT CATCH
OYSTERS BY TONGS OR PATENT TONGS EXCEPT DURING THE
TONGING SEASON FROM SEPTEMBER 1 TO MARCH 31 THE
FOLLOWING YEAR. HOWEVER, IN THE WATERS OF WORCESTER
COUNTY, THE TONGING SEASON IS FROM JANUARY 1 TO
DECEMBER 31, INCLUSIVE.
(C) DREDGING SEASON. - A PERSON MAY NOT CATCH
OYSTERS BY DREDGE IN THE WATERS OF THE STATE WHERE
DREDGING IS PERMITTED EXCEPT DURING THE DREDGING
SEASON FROM NOVEMBER 1 TO MARCH 15 OF THE FOLLOWING
YEAR.
REVISOR'S NOTE: Subsection (a) presently appears
as Article 66C, section 698 (d) of the Code.
The reference in the present statute to the
inspector of the Department of Tidewater
Fisheries is proposed for deletion since
his duties have been assumed by the Natural
Resources Police Force created by Chapter
348, Acts of 1972.
Subsection (b) presently appears as Article
66C, section 700(1) of the Code.
Subsection (c) presently appears as Article
66C, section 702(i) of the Code and is set
forth here for organizational purposes.
