696                                       LAWS OF MARYLAND                             [Ch. 4

(A)    FEDERAL RESEARCH LABORATORY AT OXFORD. - A
PERSON MAY NOT CATCH OYSTERS OR CLAMS WITHIN 400 YARDS
OF THE FEDERAL RESEARCH LABORATORY AT OXFORD.

(B)   POLLUTED AREAS. - A PERSON MAY NOT CATCH
OYSTERS OR CLAMS ON ANY AREA CLOSED BY THE DEPARTMENT
OF HEALTH AND MENTAL HYGIENE DDE TO POLLUTION.
HOWEVER, OYSTERS MAY BE TRANSPLANTED FROM AREAS DEEMED
POLLUTED DURING THE CLOSED SEASON IN ACCORDANCE WITH
THE PROVISIONS OF §4-1009 AND §4-1106.

REVISOR'S NOTE: Subsection (a) presently appears
as Article 66C, section 698(h) of the Code.
Subsection (b) presently appears as Article
66C, section 698 (f). The reference in
present section 698(f) to present section
707 (g) and 708 (x) is proposed for deletion
since the provisions of these sections are
set forth in section 4-1106 and section
4-1009, respectively. The only other
changes made are in style.

4-1007. DESIGNATION OF BUYING STATIONS FOR OYSTERS
AND CLAMS; UNLAWFUL SALES OR PURCHASES; EXCEPTION.

THE DEPARTMENT MAY DESIGNATE BY RULE OR
REGULATION CERTAIN AREAS OF THE STATE, KNOWN AS BUYING
STATIONS, WHERE A PERSON WHO CATCHES OYSTERS AND CLAMS
MAY SELL THEM. A PERSON MAY NOT SELL HIS CATCH IN ANY
PLACE NOT DESIGNATED A BUYING STATION. A PERSON MAY
NOT BUY OYSTERS OR CLAMS FROM THE PERSON WHO CATCHES
THEM IN ANY PLACE NOT DESIGNATED A BUYING STATION.
HOWEVER, ANY PERSON MAY BUY SOFT-SHELL CLAMS ANYWHERE
FOR HIS OWN CONSUMPTION OR USE AS BAIT, BUT NOT FOR
RESALE FROM THE PERSON WHO CATCHES THEM. HOWEVER, THE
PERSON WHO CATCHES THE SOFT-SHELL CLAMS SHALL ASSUME
RESPONSIBILITY FOR PAYING THE TAX IMPOSED BY §4-1036
OF THIS SUBTITLE.

REVISOR'S NOTE: This section presently appears as
Article 66C, section 706(d). It appears
here for organization purposes. The last
sentence is clarified to pertain only to
soft shell clams because the tax referred
to only relates to such clans. The only
other changes made are in style.
