State" is used to maintain consistency with
the language used throughout this title.
The provision where to obtain the license
appears in section 4—806.
In subsection (e) the term "Natural
Resources Police officer" is substituted
for "Maryland Marine Police force" in light
of Chapter 348, Acts of 1972 which created
the Natural Resources Police force. Also,
"law enforcement officer" is used in place
of the present language, "officer of the
State", to avoid the possibility of
including employees of the department.
4--805. COMMERCIAL CRABBING BY NON-RESIDENTS OF THE
STATE PROHIBITED.
A NON-RESIDENT OF THE STATE MAY NOT CATCH CRABS
FOR COMMERCIAL PURPOSES IN THE WATERS OF THE STATE.
REVISOR'S NOTE; This section is new language
derived from the identical provision
presently appearing in Article 66C, section
322 of the Code. The phrase "in the waters
of the State" has been used to maintain
consistency with this provision of this
title.
4-806. APPLICATION FOR COMMERCIAL CRABBING LICENSE;
WHERE OBTAINED; TEMPORARY LICENSE; DISPOSITION OF
FEES.
(A) WHERE OBTAINED. - A COMMERCIAL CRABBER'S
LICENSE MAY BE OBTAINED FROM THE CLERK OF THE CIRCUIT
COURT FOR THE COUNTY IN WHICH THE PERSON RESIDES OR
FROM THE CLERK OF THE COURT OF COMMON PLEAS, IF HE
RESIDES IN BALTIMORE CITY.
(B) CONTENTS OF APPLICATION; OATH OF APPLICANT.
- EVERY PERSON WHO APPLIES FOR A COMMERCIAL CRABBING
LICENSE TO CATCH CRABS UNDER THE PROVISIONS OF THIS
SUBTITLE SHALL COMPLETE AN APPLICATION FORM SHOWING
HIS FULL NAME, SOCIAL SECURITY NUMBER, AGE, AND
RESIDENCE, AND SHALL MAKE OATH OR AFFIRMATION BEFORE
THE COURT CLERK OR A NOTARY PUBLIC IN THE COUNTY THAT
THE FACTS SET FORTH IN THE COMPLETED APPLICATION FORM
ARE TRUE, AND THAT HE SHALL SUBMIT TO THE DEPARTMENT
