672                                       LAWS OF MARYLAND                            [Ch. 4

(B)    POSSESSION OR SALE. - A PERSON MAY NOT
CATCH, OFFER FOR SALE, OR POSSESS ANY SHAD OR HERRING
FRESHLY CAUGHT IN THE STATE BETWEEN JUNE 11 AND
DECEMBER 31, INCLUSIVE. HOWEVER, FROM JUNE 6 TO JULY
5, A PERSON MAY CATCH OR POSSESS SHAD TAKEN BY MEANS
OF HOOK AND LINE.

(C)   SEASON TO COINCIDE WITH VIRGINIA SEASON. -
THE SEASON FOR CATCHING SHAD AND HERRING IN THE TIDAL
WATERS SHALL BE SHORTENED BY FIVE DAYS FROM THE END OF
EACH SEASON IF VIRGINIA SHORTENS ITS SEASON FOR
CATCHING SHAD AND HERRING BY 10 DAYS FROM THE END OF
THE SEASON, OR TAKES ACTION CONTINGENT UPON ACTION BY
THIS STATE SHORTENING ITS SEASON FOR SHAD AND HERRING
IN ITS TIDAL WATERS BY 5 DAYS OR LESS FROM THE END OF
THE SEASON.

REVISOR'S NOTE: This section presently appears as
Article 66C, section 295 (a), (b) and (a) of
the Code. The only changes made are in
style.

4-738. FISHING RESTRICTIONS CONCERNING SNAPPING
TURTLES.

(A)    ONLY RESIDENTS MAY CATCH. - ONLY A RESIDENT
OF THE STATE MAY CATCH SNAPPING TURTLES IN THE WATERS
OF THE STATE. THE DEPARTMENT SHALL PRESCRIBE BY RULES
AND REGULATIONS THE METHODS TO CATCH SNAPPING TURTLES.

(B)    RESTRICTIONS IN CHARLES COUNTY. - A PERSON
MAY NOT CATCH OR ATTEMPT TO CATCH SNAPPING TURTLES IN
THE TRIBUTARY WATERS OF CHARLES COUNTY FROM APRIL 15
TO MAY 31, INCLUSIVE. A PERSON MAY NOT USE HOOK AND
LINE AND TROTLINE TO CATCH SNAPPING TURTLES IN THESE
WATERS.

REVISOR'S NOTE: Subsection (a) presently appears
as Article 66C, section 268A of the Code.
Although there is a provision in section
4-703 which generally repeats the first
sentence of this section, it relates to
fish. Thus, this part of section 268a is
retained since snapping turtles are aquatic
animals and not fish. The last provision
of present section 268A is proposed for
deletion in light of the uniform penalty
provision. Subsection (b) is derived from
the second and third sentences of Article
66C, section 275 of the Code. The only
