first two sentences of section 314(b). The
remainder of section 314(b) is proposed for
deletion and appears in other subsections
of this proposed section.
Subsection (d) is new language derived from
Article 66C, section 315(a) and
incorporates the provisions of section
315(b) relating to black bass. In
addition, the provisions of section 314(b)
relating to transportation and possession
of black bass, and pike are included for
purposes of clarity and organization.
Article 66C, section 315(a) is proposed for
deletion because its substance is set forth
here.
Subsection (e) is new language based
entirely upon the last sentence of section
314(b). By making this proviso applicable
to the entire section, the Code user will
realize that black bass do not include
black sea bass.
Article 66C, section 315(a) and (b) is
proposed for deletion since the provisions
are incorporated in subsections (c) and
(d).
The only other changes made are in style.
4-736. RESTRICTIONS CONCERNING EELS.
THE DEPARTMENT MAY SUPERVISE, REGULATE, AND
CONTROL CATCHING EELS IN THE TIDAL WATERS OF THE
STATE. IN EXERCISING THIS POWER, THE DEPARTMENT MAY
PRESCRIBE THE AREAS WITHIN AND METHODS BY WHICH EELS
MAY BE CAUGHT.
REVISOR'S NOTE: This section is new language
derived from Article 66C, section 13C of
the Code. It is inserted here for purposes
of clarity and organization. Article 66c,
section 13c is proposed for deletion.
