4-627. COMPLIANCE WITH SUBTITLE AND REGULATIONS.

A PERSON MAY NOT CATCH OR POSSESS ANY GAME AND
FRESHWATER FISH EXCEPT DURING THE PERIOD AND IN THE
MANNER PROVIDED IN THIS SUBTITLE, UNLESS CHANGED BY
RULE OR REGULATION THE DEPARTMENT PROMULGATES.

REVISOR'S NOTE: This section presently appears as
Article 66C, section 206 of the Code. The
only changes made are in style.

SUBTITLE 7. LICENSING, REGULATION, AND SUPERVISION OF
FISHING AND FISHERIES IN TIDAL WATERS.

[[4-701. RULES AND REGULATIONS.

(A) AUTHORITY TO ADOPT RULES AND REGULATIONS. -
NOTWITHSTANDING ANY OTHER PROVISION OF THIS TITLE, THE
SECRETARY AFTER CONSULTING WITH THE COMMITTEE OF
WATERMEN AND SEAFOOD DEALERS OR PROCESSORS CREATED BY
SUBSECTION (B) OF THIS SECTION, MAY PROMULGATE RULES
AND REGULATIONS RELATING TO CATCHING, POSSESSING,
SELLING, PURCHASING, TRANSPORTING, OR EXPORTING ANY
FISH IN THE TIDAL WATERS OF THE STATE. THE RULES AND
REGULATIONS MAY INCLUDE, BUT ARE NOT LIMITED TO,
PROVISIONS TO ENLARGE, EXTEND, RESTRICT, OR PROHIBIT
THE CATCHING, POSSESSING, SELLING, PURCHASING,
TRANSPORTING, OR EXPORTING OF ANY FISH IN THE TIDAL
WATERS OF THE STATE. ANY RULE OR REGULATION
PROMULGATED PURSUANT TO THE PROVISIONS OF THIS SECTION
BECOME NULL AND VOID ON JULY 1, 1973.

(E) COMMITTEE OF WATERMEN AND SEAFOOD DEALERS OR
PROCESSORS CREATED AND CONTINUED. - THE COMMITTEE OF
WATERMEN AND SEAFOOD DEALERS OR PROCESSORS IS CREATED
AND CONTINUED. IT IS COMPOSED OF A PERSON FROM EACH
COUNTY WHO HOLDS A COMMERCIAL LICENSE TO CATCH FISH,
AND 13 SEAFOOD DEALERS OR PROCESSORS.

(C)   ELECTION OF COMMITTEE MEMBERS; WHO MAY VOTE.
- THE SEAFOOD DEALERS OR PROCESSORS SHALL BE ELECTED
ACCORDING TO PROCEDURES THE SECRETARY ADOPTS AFTER
CONSULTATION WITH ORGANIZATIONS OF SEAFOOD DEALERS AND
PROCESSORS IN THE STATE. THE COMMITTEE MEMBERS FROM
EACH COUNTY SHALL BE ELECTED BY SECRET BALLOT
ACCORDING TO RULES AND REGULATIONS THE SECRETARY
ADOPTS. ONLY THE HOLDER OF A COMMERCIAL LICENSE TO
CATCH FISH MAY VOTE IN THE ELECTION.

(D)   COMMITTEE MEETINGS. - THE COMMITTEE SHALL
MEET WITH THE SECRETARY AT LEAST TWICE EACH YEAR TO
