(E) BAIT SOLD OR KEPT IN POSSESSION; INSPECTION
OF BAIT BOXES.-- A LIVE BAIT DEALER MAY SELL ONLY
MINNOWS, CHUBS MEASURING LESS THAN SIX INCHES IN
LENGTH, AND KILLIFISHES AND MAD TOMS PROCURED FROM THE
WATERS OF THE POTOMAC RIVER. HE MAY NOT POSSESS MORE
THAN 750 BAIT FISH OF EVERY TYPE AT ONE TIME. THE
BAIT BOXES OF THE LIVE BAIT DEALER SHALL BE OPEN FOR A
NATURAL RESOURCES POLICE OFFICER TO INSPECT AT ANY
REASONABLE TIME.
(C) LIMITATION ON BAIT FISH SOLD; TRANSPORTATION
AND SALE OUTSIDE THE COUNTY. - A LIVE BAIT DEALER MAY
NOT SELL MORE THAN 35 BAIT FISH TO ANY PERSON IN ANY
DAY. A LICENSEE MAY NOT TRANSPORT BAIT FISH OUT OF
THE COUNTY WHERE PURCHASED OR SELL IT OUTSIDE THAT
COUNTY. A PURCHASER FROM THE LICENSEE MAY NOT RESELL
BAIT FISH BUT MAY TRANSPORT IT OUTSIDE OF THE COUNTY
WHERE PURCHASED.
REVISOR'S NOTE: This section presently appears as
Article 66C, section 212(a) of the Code.
The provisions of section 213(a) of the
Code are combined and the section therefore
is proposed for deletion. The present
reference to the agent of the clerk of the
Circuit Court has been omitted since it is
assumed that the clerk's agent can perform
these functions. In addition, the
reference to the first day of July, 1955,
in section 212 (a) and the first day of
July, 1957, in section 213 (a) is proposed
for deletion as obsolete.
Subsections (b) and (c) presently appear as
Article 66C, section 212 (b) and (c) of the
Code which deal only with Montgomery
County. They are drafted to apply to
licenses issued in Frederick and Washington
counties as well, since identical
provisions in section 213(b) and (c)
concern those counties. Accordingly,
sections 213(b) and (c) are proposed for
deletion.
In addition, the penalty provisions of
sections 212(d) and 213 (d) , as amended by
Chapter 181, Acts of 1972, are proposed for
deletion in light of the uniform penalty
