1-204. POWERS AND DUTIES OF NATURAL RESODRCES POLICE
OFFICERS.

(A)    LAW ENFORCEMENT POWERS.—IN ADDITION TO ANY
OTHER POWERS CONFERRED BY THIS TITLE, THE SECRETARY
AND EVERY NATURAL RESOURCES POLICE OFFICER SHALL HAVE
ALL THE POWERS CONFERRED UPON POLICE OFFICERS OF THE
STATE. THESE POWERS MAY BE EXERCISED ANYWHERE WITHIN
THE STATE. THE NATURAL RESOURCES POLICE FORCE
SPECIFICALLY IS CHARGED WITH ENFORCING THE NATURAL
RESOURCE LAWS OF THE STATE.

(B)    PERFORMANCE OF DUTIES.—EVERY NATURAL
RESOURCES POLICE OFFICER APPOINTED UNDER THIS SECTION
SHALL PERFORM DUTIES THE SECRETARY DESIGNATES.

REVISOR'S NOTE: Subsection (a) presently appears
as Article 66C, section 118(a) of the Code.
The reference to "salaried law enforcement
personnel" is proposed for deletion and
"Natural Resources Police officer" is
substituted therefor because the Natural
Resources Police are the only salaried law
enforcement personnel within the
department. The reference to "constables"
is proposed for deletion because that
office, as a law enforcement officer, was
abolished by Chapter 181, Acts of 1972.
New language is added to indicate that the
Natural Resources Police Force is
specifically responsible for enforcing the
natural resources laws. Subsection (b)
presently appears as Article 66C, section
116 (c) of the Code.

The only other changes made are in style.

1-205. CITATIONS; WRITTEN PROMISE TO APPEAR; FAILURE
TO APPEAR.

(A) OFFICERS TO ISSUE CITATIONS.—WHENEVER A
PERSON IS APPREHENDED BY A NATURAL RESOURCES POLICE
OFFICER FOR VIOLATING ANY LAW PUNISHABLE AS A
MISDEMEANOR THE OFFICER SHALL PREPARE AND SIGN A
WRITTEN CITATION CONTAINING A NOTICE TO APPEAR IN
COURT, THE NAME AND ADDRESS OF THE PERSON CHARGED,
APPROPRIATE LICENSE NUMBERS, IF ANY, THE OFFENSE
CHARGED, THE TIME AND PLACE THE PERSON SHALL APPEAR IN
COURT, AND OTHER PERTINENT INFORMATION REQUIRED BY THE
SECRETARY.
