authorizing the Secretary to appoint
"wildlife technicians, biologists,
scientists, or other employees" is proposed
for deletion. The Natural Resources Police
Force does not employ such persons but
rather technical work is performed by the
technicians and engineers in other
departmental units. Other provisions in
this article give the Secretary sufficient
authority to employ persons with talents
needed by the department. The reference to
compensation and expenses is proposed for
deletion because these are allocated for in
the State budget. The reference to the
merit system also is proposed for deletion
as superfluous and it duplicates the
provisions in Article 64A, sections 1 and 3
of the Code.
Subsections (b), (c) and (d) presently
appear as Article 66C, sections 117 and
119, as amended by Chapter 181, Acts of
1972. The reference to "deputy wildlife
officers", which previously were appointed
by the governor, is proposed for deletion
because appointments are no longer made.
The provision requiring transmission of
wildlife officer badges to the clerk of the
circuit court is proposed for deletion.
The inland division of the Natural
Resources Police Force will be commissioned
and sworn in by the Superintendent as the
Marine Police are now. The Director of the
Administrative Office of the Courts and the
Clerk of the Circuit Court of Wicomico
County have stated that they have no
objection to this change. Presently, the
clerks receive $1 to cover recording costs.
The reference to the Director's badge is
proposed for deletion because it is
obsolete. Pursuant to the provisions of
Chapter 348, Acts of 1972, the Secretary
would receive this badge although it is
highly unlikely that he would ever
personally exercise his police powers. The
penalty provision of section 119 is
proposed for deletion in light of the
penalty provision of this subtitle.
The only other changes made are in style.
