SEC. 10-107. DISTRIBUTION OF BALLOTS; POLL HOLDERS;
CANVASS OF RESULT OR REFERENDUM.

THE CERTIFIED AGENCY SHALL PREPARE AND DISTRIBUTE
IN ADVANCE OF THE REFERENDUM ALL NECESSARY BALLOTS
AND, UNDER RULES AND REGULATIONS ADOPTED BY THE
CERTIFIED AGENCY, ARRANGE FOR THE NECESSARY POLL
HOLDERS FOR CONDUCTING THE REFERENDUM. WITHIN TEN
DAYS AFTER THE REFERENDUM, THE CERTIFIED AGENCY SHALL
CANVASS AND PUBLICLY DECLARE THE RESULT OF THE
REFERENDUM.

REVISOR'S NOTE: This section presently appears as
Art. 66C, §83N of the Code. The present
reference to "producers of any agricultural
product among whom a referendum shall be
conducted under the provisions of this
article" is proposed for deletion. This
reference duplicates the definition of
"certified agency"; See §10-101(c). The only
other changes made are in style.

SEC. 10-108. EFFECT OF REFERENDUM VOTE.
(A) ANNOUNCEMENT.

IF AT LEAST TWO THIRDS OF THOSE PERSONS QUALIFYING
AS VOTERS AND VOTING IN THE AREA IN WHICH THE
REFERENDUM IS CONDUCTED, VOTE IN FAVOR OF THE LEVYING
AND COLLECTION OF THE PROPOSED ASSESSMENT ON THE
AGRICULTURAL COMMODITY, THEN THE ASSESSMENT SHALL BE
ANNOUNCED BY THE AGENCY CONDUCTING THE REFERENDUM.

(B) COLLECTION OF ASSESSMENT.

THE ASSESSMENT SHALL BE COLLECTED PURSUANT TO THE
METHOD AND RULES AND REGULATIONS ADOPTED BY THE
CERTIFIED AGENCY CONDUCTING THE REFERENDUM. IT SHALL
BE COLLECTED ANNUALLY FOR THE NUMBER OF YEARS SET
FORTH IN THE CALL FOR THE REFERENDUM.

REVISOR'S NOTE: Subsection (a) presently appears
as Art. 66C, §83L of the Code.

Subsection (b) is new language derived from
the first sentence of Art. 66C, §83-0 of the
Code.

The only changes made are in style.
