Subsections (b) and (d) presently appear as
Art. 66C, §83H of the Code and are set forth
here for organizational purposes. In
subsection (b) the provision requiring the
certified agency, board, etc. to "fix" the
referendum date is proposed for deletion
because this act is synonymous with
"determining" the date.

In subsection (d), the last phrase        is

proposed for deletion and a reference to   any

person qualifying as a voter is added for   the

reasons explained in the revisor's note     to
§10-104.

The only other changes made are in style.

SEC. 10-106. REFERENDUM ON AREA OR STATE-WIDE BASIS;
PARTICIPATION; QUESTION.

(A)   REFERENDUM MAY BE ON AREA OR STATE-WIDE
BASIS.

ANY REFERENDUM MAY BE HELD EITHER ON AN AREA OR
STATE-WIDE BASIS, AS DETERMINED BY THE CERTIFIED
AGENCY BEFORE THE REFERENDUM IS CALLED.

(B)   PARTICIPATION.

ANY PERSONS QUALIFYING AS A VOTER MAY PARTICIPATE

IN THE REFERENDUM.

(C)   QUESTION FOR REFERENDUM.

THE VOTERS SHALL VOTE UPON THE QUESTION OF WHETHER
AN ANNUAL ASSESSMENT SHALL BE LEVIED FOR A PERIOD OF
FIVE YEARS IN THE AMOUNT SET FORTH IN THE CALL FOR THE
REFERENDUM ON THE AGRICULTURAL COMMODITY.

REVISOR'S NOTE: This section presently appears as
Art. 66C, §83J of the Code. The first phrase
of subsection (c) is proposed for deletion
and "voter" is substituted for the reasons
explained in the revisor's note to §10-104.
In subsection (c), present reference to
"agricultural product" is proposed for
deletion and "agricultural commodity" is
substituted to maintain consistency with
§10—101(b). The only other changes made are
in style.
