THE AGENCY IMMEDIATELY SHALL REPORT THE FACTS TO THE
AUTHORITY WHICH SHALL TAKE LEGAL ACTION AS THE NATURE
OF THE CASE MAY REQUIRE.

REVISOR'S NOTE: Subsection (a) is new language
derived from the second sentence of Art. 48,
§61(g) of the Code.

Subsections (b) and (c) presently appear as
Art. 48, §61(g) of the Code. The present
reference to "producer" is proposed for
deletion for the reasons explained in the
revisor's note to §7—411.

SEC. 7-416. MISREPRESENTATION OF WEIGHT PROHIBITED.

ANY WEIGHMAN OR PERSON ACTING AS WEIGHMAN, IN ANY
LEAF TOBACCO MARKET MAY NOT KNOWINGLY AND
INTENTIONALLY MISREPRESENT OR ATTEMPT TO MISREPRESENT
THE WEIGHT OF ANY TOBACCO WEIGHED BY HIM ON THE
WAREHOUSE FLOOR.

REVISOR'S NOTE: This section presently appears as
Art. 48, §53 of the Code. The present
reference to "any market engaged in selling
or storing leaf tobacco in Maryland" is
proposed for deletion and "leaf tobacco
market" is added in light of the definition
set forth in §7—101(e). According to the
department, this section is intended to apply
to the State Warehouse as well as private
warehouses. The present provisions of this
section that provides that violation of this
section is a misdemeanor and prescribes the
penalty is proposed for deletion in light of
the uniform penalty provision of this
Article. The only other changes made are in
style.

SEC. 7-417. ENFORCEMENT.

THE STATE'S ATTORNEY OF EACH COUNTY OR BALTIMORE
CITY SHALL ENFORCE THE PROVISIONS OF THIS SUBTITLE.
