THE TIME OF THEIR SELECTION AND DO NOT HAVE ANY DIRECT
OR INDIRECT FINANCIAL OR OTHER INTEREST IN THE BUYING
OR SELLING OF LEAF TOBACCO, EXCEPT A PRODUCER'S
INTEREST. THEY SHALL BE SELECTED FROM A LIST OF 15
NOMINEES SUBMITTED BY THE MARYLAND FARM BUREAU, INC.
AT LEAST TWO OF THE FIVE MEMBERS SHALL BE MEMBERS OF
THE POLITICAL PARTY WHICH RECEIVED THE SECOND HIGHEST
NUMBER OF VOTES IN THE PRECEDING GUBERNATORIAL
ELECTION. NO TWO PRODUCER MEMBERS OF THE AUTHORITY
MAY BE RESIDENTS OF THE SAME COUNTY.
(E) TENURE.
THE TERM OF EACH MEMBER IS THREE YEARS OR UNTIL
HIS SUCCESSOR IS SELECTED AND QUALIFIES.
(C) VACANCIES.
IF A VACANCY OCCURS FOR ANY REASON, THE GOVERNOR
SHALL APPOINT ANOTHER PERSON TO SERVE FOR THE
REMAINING PORTION OF THE UNEXPIRED TERM. ANY NEW
APPOINTEE FOR AN EXPIRED OR UNEXPIRED TERM SHALL BE A
PERSON WITH QUALIFICATIONS SIMILAR TO THOSE OF THE
NEXT PREVIOUS INCUMBENT, SO AS TO PRESERVE THE BALANCE
OF REPRESENTATION FOR THE SEVERAL GROUPS PROVIDED IN
THIS SECTION.
REVISOR'S NOTE: Subsection (a) is new language
derived from Art. 48, §56(b) of the Code. In
sub—paragraphs (2) and (3) references in
§56 (b) to a "representative of the several
persons or agencies selling leaf tobacco" and
"a representative of the several persons or
agencies buying leaf tobacco" are omitted.
References to "a person who is in the
business of buying leaf tobacco" and "a
person who is in the business of selling leaf
tobacco" are substituted. The word "agency"
is not used because it can be interpreted to
connote a public agency.
In sub-paragraph (2), the present provision
requiring the Authority to select a member
from a list of three submitted by tobacco
selling agencies is proposed for deletion
because it is meaningless. There are no
tobacco selling agencies in the State.
Subsections (b) and (c) presently appear as
