WHO SELLS TOBACCO ON BEHALF OF AN OWNER OF LEAF
TOBACCO OR A PERSON IN CHARGE OF A LEAF ACCOUNT.

REVISOR'S NOTE: This subsection is new language
suggested by the Department to define this
term which is used throughout the present
statute without definition. This definition
refers to a "person who sells tobacco" in
light of the fact that the definition of
"person" includes a firm, corporation, or
association; See §1-101(f).

This definition includes a person in charge
of a leaf account because these persons are
required to obtain a commission selling
agency license under Art. 48, §66 (c—1).

The phrase "leaf tobacco" is used throughout
this title to distinguish it from "processed
tobacco".

(D)   "INSPECTOR" MEANS THE TOBACCO INSPECTOR.

"Tobacco Inspector".

(E)   "LEAF TOBACCO MARKET" MEANS ANY ESTABLISHMENT
WHERE LOOSE LEAF TOBACCO IS SOLD BY AUCTION SALE OR
STORED OR SOLD IN HOGSHEADS.

REVISOR'S NOTE: This subsection is new language
added to refer to either type of
establishment where tobacco is sold; the
private loose leaf auction market, which is
regulated by the Tobacco Authority, or the
State Warehouse where tobacco is sold and
stored in hogsheads.

(F)    "MEMBER" MEANS A MEMBER OF THE TOBACCO
AUTHORITY.

added to avoid repetitive use of the phrase
"member of the Tobacco Authority."

(G)    "SALES FLOOR BUYER" MEANS A PERSON WHO
PURCHASES LEAF TOBACCO ON THE SALES FLOOR OF ANY
PRIVATE TOBACCO WAREHOUSE.
