1606                                       LAWS OF MARYLAND                            [Ch. 6

(A)   QUARANTINE.

UPON DISCOVERY OF FOUL BROOD, BLACK BROOD, OR
OTHER INFECTIOUS OR CONTAGIOUS DISEASES IN ANY APIARY
OR COLONY, THE SECRETARY SHALL SEND TO THE OWNER OF
THE DISEASED BEES A WRITTEN ORDER REQUIRING THE BEES
TO BE HELD IN QUARANTINE UNTIL RELEASED BY A WRITTEN
PERMIT FROM THE SECRETARY.

(B)   INSTRUCTIONS FOR TREATMENT.

UPON THE DISCOVERY OF FOUL BROOD, BLACK BROOD, OR
OTHER INFECTIOUS OR CONTAGIOUS DISEASE IN ANY APIARY
OR COLONY, THE SECRETARY SHALL INSTRUCT THE OWNER OR
CARETAKER CONCERNING THE TREATMENT OF THE DISEASED
COLONIES. IF, UPON SUBSEQUENT INSPECTION, THE DISEASE
STILL IS FOUND TO EXIST IN THE APIARY OR COLONY, THE
SECRETARY MAY DESTROY OR ORDER THE DESTRUCTION OF THE
DISEASED COLONY IN A MANNER THAT PREVENTS THE SPREAD
OF THE DISEASE.

REVISOR'S NOTE: Subsection (a) presently appears
as Art. 48, §104 of the Code. The last
clause of this section is proposed for
deletion because it is superseded by the
uniform penalty provisions of this Article.

Subsection (b) presently appears as Art. 48,
§105 of the Code.

The only other changes made are in style.
SEC. 5-504. RIGHT OF ENTRY.

TO ENFORCE THE PROVISIONS OF THIS SUBTITLE, THE
SECRETARY MAY ENTER ALL PLACES WHERE BEES, BEE
PRODUCTS, SUPPLIES, OR APPLIANCES USED IN APIARIES ARE
KEPT.

REVISOR'S NOTE: This section presently appears as
the first sentence of Art. 48, §107 of the
Code. The last sentence is proposed for
deletion because it duplicates the provisions
of §2—103. The only other changes made are
in style.

SEC. 5-505. DUTY OF BEEKEEPER TO NOTIFY SECRETARY OF
DISEASED COLONIES; POSSESSION OR DISTRIBUTION
PROHIBITED.
