ANY INFORMATION CONTAINED IN THE APPROVED STATE
REGISTRATION OF THE PESTICIDE. A PERSON MAY NOT USE,
APPLY, OR RECOMMEND USE OF A PESTICIDE IN A MANNER
OTHER THAN AS SPECIFIED BY THIS SUBTITLE OR RULES AND
REGULATIONS ADOPTED UNDER IT.
REVISOR'S NOTE: This section presently appears as
Art. 66C, §110A-7 of the Code. The present
references to "agency of State or local
government" are proposed for deletion because
they are encompassed within the definition of
"person" appearing in §1-101(f). The only
other changes made are in style.
SEC. 5-211. PENALTY.
NOTWITHSTANDING ANY OTHER PROVISION OF THIS
ARTICLE, ANY PERSON WHO VIOLATES ANY PROVISION OF THIS
SUBTITLE IS GUILTY OF A MISDEMEANOR AND, UPON
CONVICTION, IS SUBJECT TO A FINE NOT EXCEEDING $1,000,
OR IMPRISONMENT NOT EXCEEDING 60 DAYS, OR BOTH, WITH
COSTS IMPOSED IN THE DISCRETION OF THE COURT.
REVISOR'S NOTE: This section is new language
derived from Art. 66C, §110A-10 of the Code.
Language is added to indicate that this
penalty supersedes the uniform penalty
provision.
SUBTITLE 3. PLANT DISEASE CONTROL.
SEC. 5-301. DEFINITIONS.
(A) IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.
REVISOR'S NOTE: This subsection is new language
used as the standard introductory sentence to
a definition section.
(B) "DEALER" MEANS ANY PERSON, EXCEPT A
NURSERYMAN, WHO BUYS, COLLECTS, OR OTHERWISE ACQUIRES
WILD PLANTS OR NURSERY STOCK FOR THE PURPOSE OF
RESELLING OR DISTRIBUTING THEM.
REVISOR'S NOTE: This subsection is new language
suggested by the Department to define a word
used in this subtitle, in accordance with the
present legislative intent.
