CUSTOM APPLICATOR OR A REGISTERED PEST CONTROL
OPERATOR, OR BY A PERSON APPLYING PESTICIDES TO HIS
HOME, GARDEN, OR YARD;

(9)    APPLICATION OF ANY PESTICIDE BY ANY
ARBORIST LICENSED BY THE DEPARTMENT OF NATURAL
RESOURCES;

(10)      APPLICATION OF ANY PESTICIDE ON
ORNAMENTAL TREES OR PLANTS ON RESIDENTIAL PROPERTIES
OF ONE ACRE OR LESS.

Art. 66C, §110A-5 of the Code.

Paragraph (3) is revised to reflect the
definition of "person" set forth in §1—101(f)
of this Article which would include "colleges
and universities. State agencies,
municipalities, public utilities", etc.

In paragraph (7), new language conforming to
paragraph (8) is added.

In paragraph (9), the reference to the
"department of forests and parks" is proposed
for deletion because it has been abolished.
The Department of Natural Resources now
exercised its functions; See Ch. 348, Acts of
1972.

The only other changes made are in style.

SEC. 5-209. SUPERVISION BY LICENSED CUSTOM APPLICATOR
OR PEST CONTROL OPERATOR.

ANY CUSTOM OR COMMERCIAL APPLICATION OF ANY
PESTICIDE SHALL BE UNDER THE SUPERVISION OF A LICENSED
CUSTOM APPLICATOR OR LICENSED PEST CONTROL OPERATOR
WHO IS RESPONSIBLE AND LIABLE FOR PERFORMANCE.

Art. 66C, §110A-6 of the Code. New language
is added to clarify the present legislative
intent of this section. The only changes

SEC. 5-210. LABELS; UNLAWFUL USE OF PESTICIDE.

A PERSON MAY NOT USE, APPLY, OR RECOMMEND USE OF A
PESTICIDE OTHER THAN AS SPECIFIED BY THE LABEL. THE
