§4-108. In subparagraph (2) a reference to
"livestock" is added to the last clause
instead of the present reference to
"cattle, sheep, swine, goats or equines" in
light of the definition of "livestock" set
forth in §1-101(e). Subparagraph (5) is
new language derived from the first
sentence of Art. 66c, §470J (a) of the Code
and set forth here for organizational
purposes. A reference to "meat food
product" is added and the present reference
to "products of livestock" is omitted to
maintain consistency with other provisions
of this section.
Subsection (b) presently appears as Art.
66C, §470N(c) of the Code. The last phrase
is proposed for deletion in light of the
uniform penalty provision of this Article.
Subsection (c) presently appears as Art.
66C, §470N(d) of the Code.
The only other changes made are in style.
SEC. 4-110. ESTABLISHMENTS REQUIRED TO BEAR
INSPECTION COSTS; EXCEPTIONS.
THE STATE SHALL BEAR THE COST OF INSPECTION
RENDERED UNDER THIS SUBTITLE, EXCEPT AS PROVIDED IN
§4-104. HOWEVER, EACH ESTABLISHMENT SUBJECT TO THIS
SUBTITLE SHALL PAY THE COST OF OVERTIME AND HOLIDAY
INSPECTION WORK AT RATES THE SECRETARY DETERMINES.
SUMS RECEIVED BY THE SECRETARY IN REIMBURSEMENT OF
SUMS PAID OUT FOR PREMIUM PAY WORK SHALL BE AVAILABLE
WITHOUT FISCAL YEAR LIMITATIONS TO CARRY OUT THE
PURPOSES OF THIS SUBTITLE.
REVISOR'S NOTE: This section presently appears as
Art. 66C, §470X(a) of the Code. Art. 66C,
§470X(b) is proposed for deletion. The
first sentence of this section is
unnecessary because the General Assembly is
authorized to appropriate funds for the
Department of Agriculture and, likewise,
§2-103 authorizes the Secretary to submit
an annual budget. The last sentence is
proposed for deletion because its substance
is set forth in §4-102(b).
