GRAZING AND FEEDING PURPOSES AND THE SALE OR DISPOSAL
OF THESE ANIMALS AFTER THE GRAZING AND FEEDING PERIOD.

SURPLUS, OR UNPROFITABLE ANIMAL OWNED BY HIM.
(4) THE SALE, EXCHANGE, OR TRANSPORTATION
OF ANY EQUINE.
REVISOR'S NOTE: This section presently appears as
Art. 66C, §438 of the Code. The reference
to §§436 and 437 are proposed for deletion
because these two sections comprise the
substance of this subtitle as revised. In
paragraph (4), the present references to
"horse, pony or mule" is proposed for
deletion and a reference to any "equine" is
substituted. This paragraph is intended to
relate to any member of the horse family.
The only other changes made are in style.
SEC. 3-309. DUTY OF STATE'S ATTORNEY.
ANY STATE'S ATTORNEY TO WHOM ANY VIOLATION IS
REPORTED SHALL INSTITUTE APPROPRIATE JUDICIAL
PROCEEDINGS WITHOUT DELAY. BEFORE THE SECRETARY
REPORTS A VIOLATION FOR PROSECUTION, THE PERSON
AGAINST WHOM PROCEEDINGS ARE CONTEMPLATED SHALL BE
GIVEN THE OPPORTUNITY TO PRESENT HIS VIEW.
REVISOR'S NOTE: This section presently appears as
Art. 66C, §439 (b) of the Code. The present
reference to "auction market, sales agency,
dealer or trucker or hauler" is proposed
for deletion because this section intends
that any person against whom proceedings
are contemplated be afforded the
opportunity to present his views,
regardless of his views, whether he is a
trucker, hauler, etc. The only other
changes made are in style.
SEC. 3-310. SECRETARY MAY SEEK INJUNCTION.
NOTWITHSTANDING THE EXISTENCE OF OTHER REMEDIES
AT LAW, THE SECRETARY MAY APPLY FOR AND THE COURT MAY
GRANT A TEMPORARY OR PERMANENT INJUNCTION RESTRAINING
ANY PERSON FROM VIOLATING OR CONTINUING TO VIOLATE ANY
PROVISION OF THIS SUBTITLE OR ANY RULE OR REGULATION
ADOPTED PURSUANT TO IT. THE INJUNCTION SHALL BE
ISSUED WITHOUT BOND.
