MARVIN MANDEL, Governor 1461
REVISOR'S NOTE: This section presently appears as
Art. 66C, §434 of the Code. The reference
to hogs is proposed for deletion because
hogs are domestic animals. The last clause
is proposed for deletion in light of the
uniform penalty provision of this Article.
The only other changes made are in style.
SEC. 3-110. EXPOSURE OF HEALTHY ANIMALS TO INFECTED
ANIMALS PROHIBITED.
A PERSON MAY NOT KNOWINGLY EXPOSE
[[INTENTIONALLY]] ANY ANIMAL TO AN ANIMAL INFECTED
WITH A CONTAGIOUS OR INFECTIOUS DISEASE, OR PLACE OR
CAUSE TO BE PLACED ANY HEALTHY OR UNEXPOSED ANIMAL OF
THE SAME SPECIES ON ANY PREMISES DECLARED TO BE
INFECTED, UNTIL THE INFECTED ANIMAL IS DECLARED FREE
FROM INFECTION BY THE SECRETARY OR AGENT. IN ADDITION
TO ANY PENALTY PROVIDED BY THE PROVISIONS OF THIS
ARTICLE, ANY ANIMAL INTRODUCED INTO ANY INFECTED
LOCATION THAT HAS BEEN DECLARED INFECTED, SHALL BE
SLAUGHTERED BY THE SECRETARY OR HIS AGENT, OR UPON
ORDER OF THE SECRETARY, WITHOUT APPRAISEMENT OR
COMPENSATION FROM THE STATE.
REVISOR'S NOTE: This section presently appears as
Art. 66C, §428 of the Code. The present
reference to an "intentional" act is
proposed for deletion and a reference to a
"knowing" act is substituted because the
legislature intended this to be a malum in
se offense. The reference to animals
"affected" with a contagious or infectious
disease is proposed for deletion because
the proper word is "infected". The
reference to "his agent" is added since
this phrase is being used throughout this
subtitle. New language is added to the
last sentence to permit the slaughter of
animals upon the order of the Secretary.
This revision is made because occasionally
so many animals are infected that it is not
feasible for the Department to slaughter
all of them and it must order others to do
so. The only other changes made are in
style.
SEC. 3-111. SALE OF INFECTED ANIMALS; INOCULATION OF
ANIMALS PROHIBITED.
