1460                                       LAWS OF MARYLAND                             [Ch. 6

APPROVED BY THE SECRETARY, THE APPRAISAL SHALL BE
FILED WITH THE COMPTROLLER WHO SHALL ISSUE HIS WARRANT
TO THE TREASURER IN FAVOR OF THE OWNER FOR THE AMOUNT
OF THE APPRAISAL.

(D) APPEAL PROCEDURES.

IF THE OWNER OF THE BUILDING, ARTICLE, OR
PROPERTY IS NOT SATISFIED WITH THE APPRAISAL, HE MAY
APPEAL TO BALTIMORE CITY COURT OR THE CIRCUIT COURT OF
THE COUNTY WHERE THE BUILDING, ARTICLE, OR PROPERTY IS
LOCATED. THE APPEAL SHALL BE HEARD DE NOVO.

REVISOR'S NOTE: This section is new language
derived from Art. 66C, §430 of the Code.
New language is added throughout this
section to indicate that these procedures
are applicable to building and articles as
presently provided by §129. The only other
changes made are in style.

SEC. 3-108, DISPOSAL OF CARCASS, HIDE, AND OFFAL OF
ANY SLAUGHTERED ANIMAL.

WHEN ANY ANIMAL IS SLAUGHTERED UNDER THE
PROVISIONS OF THIS SUBTITLE, THE OWNER MAY DISPOSE OF
THE CARCASS OR ANY PART OF IT, THE HIDES, AND OFFAL,
PURSUANT TO THE DEPARTMENTAL RULES AND REGULATIONS,
AND IN A MANNER THAT DOES NOT TEND TO SPREAD DISEASE
OR ENDANGER THE PUBLIC HEALTH.

REVISOR'S NOTE: This section presently appears as
Art. 66C, §433 of the Code. In order to
express the legislative intent more
explicitly, new language is added to
provide that the owner may not destroy any
animal in a manner that tends to "endanger"
the public health. The last phrase is
proposed for deletion because it appears as
§3—112. The only other changes made are in
style.

SEC. 3-109. OWNER SHALL BURY OR BURN DOMESTIC ANIMALS
WHICH HAVE DIED OF A CONTAGIOUS OR INFECTIOUS DISEASE.

THE OWNER OF ANY DOMESTIC ANIMAL THAT HAS DIED OF
A CONTAGIOUS OR INFECTIOUS DISEASE SHALL BURY IT AT A
DEPTH OF AT LEAST THREE FEET OR BURN IT WITHIN THREE
HOURS PRIOR TO SUNSET OF THE DAY FOLLOWING THE
DISCOVERY OF THE ANIMAL.
