Art. 66C, §417 and set forth here for
organizational purposes.
In paragraph (3), new language is added to
specify that the disease must be
"contagious or infectious" in order to
maintain consistency with this section. In
paragraph (4) the reference to
"regulations" of the department is proposed
for deletion and "order" is substituted to
distinguish between department rules and
regulations adopted pursuant to the
Administrative Procedure Act and emergency
orders issued pursuant to this section.
Paragraph (8) is new language derived from
Art. 66C, §429 of the Code and set forth
here for organizational purposes. The
provision of §429 referring to "buildings,
sheds, stables, stable furniture, hay,
straw or fodder or feed" is omitted here
and "article" substituted. The general
legislative intent seems to be to allow
destruction of any article that might
spread a contagious or infectious disease.
Paragraph (10) is new language derived from
Art. 66C, §466 of the Code and set forth
here for organizational purposes.
Subsection (b) presently appears as Art.
66C, §419 of the Code. A reference to an
"agent" of the Secretary is added to
maintain consistency with other sections of
this title.
Subsection (c) is new language derived from
a similar provision of Art. 66C, §416.
This section refers to "other law
enforcement officers of the State" instead
of the present language "officers of the
State" in order to clarify the probable
legislative intent.
Subsection (d) presently appears as Art.
66C, §424 of the Code and is set forth here
for organizational purposes.
The only other changes made are in style.
