(3) NOTWITHSTANDING §3-102, PROHIBIT THE
IMPORTATION FROM ANOTHER STATE OF ANY ANIMAL HE HAS
REASON TO BELIEVE IS INFECTED WITH OR HAS BEEN EXPOSED
TO A CONTAGIOUS OR INFECTIOUS DISEASE AND DETAIN THE
ANIMAL AT ANY PLACE FOR INSPECTION OR QUARANTINE.
(E) EMERGENCY QUARANTINE.
THE SECRETARY MAY ESTABLISH, MAINTAIN, AND
ENFORCE A QUARANTINE ORDER IF HE DETERMINES IT IS
URGENT AND NECESSARY FOR THE PROMPT PERFORMANCE OF THE
PROVISIONS PROVIDED IN THIS SECTION.
(C) RULES AND REGULATIONS; DETENTION OF IMPORTED
DOMESTIC ANIMALS.
THE SECRETARY MAY ADOPT RULES AND REGULATIONS
GOVERNING THE IMPORTATION OF DOMESTIC ANIMALS INTO THE
STATE FROM ANOTHER STATE.
REVISOR'S NOTE: Subsection (a) presently appears
as Art. 66C, §413(a) of the Code. Changes
in nomenclature in this and subsequent
sections have been made in light of the
departmental reorganization pursuant to Ch.
342, Acts of 1972. The reference to
"exotic", contagious, or infectious
diseases is proposed for deletion to avoid
confusing the Code user. The thrust of
this subtitle is to prevent the spread of
contagious and infectious diseases among
livestock and, thus, any exotic disease
that is contagious or infectious falls
within these provisions. According to the
department, this subtitle is not intended
to apply to an exotic disease that is not
infectious or contagious. The reference to
"glanders in horses" likewise is proposed
for deletion because this disease is a
contagious or infectious disease.
The provision requiring the local boards of
health to report to the department is
proposed for deletion because its substance
is set forth in §3-104.
Subsection (b) is new language derived from
Art. 66C, §413 (b) which is proposed for
deletion, infra. The present section vests
