probable legislative intent is that the
seal shall authenticate all official
Department documents and papers.

In subsection (g), the present reference to
the designee of the Secretary is proposed
for deletion in light of the definition of
"Secretary" set forth in §1-101(h).

The last sentence of subsection (h) is new
language derived from a provision of former
Art. 66C, §52, which was repealed by Ch.
342, Acts of 1972. This section sets forth
the general powers and responsibilities of
the former State Board of Agriculture. All
other provisions of the State Board of
Agriculture enumerated in former §52 were
incorporated into sections enacted by Ch.
342, Acts of 1972. The addition of this
section does not result in a substantive
change because under Art. 41, §432, all
functions previously performed by the State
Board of Agriculture are performed by the
Department of Agriculture.

The only other changes made are in style.

SEC. 2-104. SECRETARY TO ENFORCE ARTICLE; ASSISTANCE
OF LAW ENFORCEMENT OFFICERS; INTERFERENCE WITH THE
SECRETARY PROHIBITED.

(A)   SECRETARY TO ENFORCE ARTICLE.

THE SECRETARY SHALL CARRY OUT AND ENFORCE THE
PROVISIONS OF THIS ARTICLE.

(B)   ASSISTANCE OF LAW ENFORCEMENT OFFICERS.

THE SECRETARY MAY CALL UPON ANY SHERIFF, DEPUTY
SHERIFF, AND ANY LAW ENFORCEMENT OFFICER OF ANY
COUNTY, FOR INFORMATION AND ASSISTANCE TO CARRY OUT
AND ENFORCE THE PROVISIONS OF THIS ARTICLE AND THE
[[DEPARTMENT]] DEPARTMENTAL RULES AND REGULATIONS.
EVERY OFFICER SHALL OBEY AND OBSERVE EVERY ORDER AND
INSTRUCTION HE RECEIVES FROM THE SECRETARY CONCERNING
THE ENFORCEMENT OF ANY PROVISION OF THIS ARTICLE AND
THE DEPARTMENTAL RULES AND REGULATIONS WITHIN HIS
RESPECTIVE JURISDICTION. EACH OFFICER SHALL BE PAID
AS FOR THE PERFORMANCE OF SIMILAR DUTIES UNDER
EXISTING LAWS.
